Trump’s Canada, Mexico, China tariffs suspend loophole behind fentanyl shipments Trump’s Canada, Mexico, China tariffs suspend loophole behind fentanyl shipments By David Lawder WASHINGTON (Reuters) – President Donald Trump’s new tariff orders against Canada, Mexico and China all contain clauses suspending a duty-free exemption for low-value shipments below $800 that is widely seen as a loophole that has allowed shipments of fentanyl and its precursor chemicals into the United States. Staunching that flow was a primary motivation cited by Trump in imposing sweeping import taxes on goods on the three largest U.S. trading partners. Absent a fully global end to the so-called “de minimis” exemption, it is not clear how effective Trump’s approach will be at curbing the flow of fentanyl. The suspension of the exemption is due to last as long as Trump’s tariffs are in place. It also could cause problems for ******** e-commerce companies, including Shein and PDD Holdings’ Temu, which have exploited the exemption to ship individual consumer goods packages directly from China to avoid previous U.S. tariffs on ******** imports. Such small shipments often are not screened at ports of entry, allowing shipments of drugs and their ingredients to enter undetected. A Reuters investigation last year revealed how ******** chemical traders are using the de minimis exception to sneak shipments of precursors into the United States, from where they are conveyed across the border to fentanyl labs in Mexico. Overdoses of fentanyl, a powerful and addictive painkilling drug, killed nearly 75,000 Americans in 2023, according to the U.S. Centers for Disease Control and Prevention. In announcing the punitive duties of 25% on goods from Canada and Mexico and an additional 10% on ******** imports, White House officials said on Saturday that the de minimis halt applied specifically to Canada. The officials criticized Canada for not cracking down on fentanyl trafficking shipments. But the orders for all three countries contain the same language addressing the de minimis exemption: “For avoidance of doubt, duty-free de minimis treatment under 19 U.S.C. 1321 shall not be available for the articles described in subsection (a) of this section.” That subsection of each order broadly identifies the imports subject to tariffs. Trump’s orders do not contain any language suggesting a global or permanent suspension of the de minimis status, leaving open the possibility that fentanyl shipments could still arrive unchecked as long as they do not originate from China, Canada or Mexico. A White House spokesperson did not immediately respond to requests for comment on the exemption. “These executive orders appear to eliminate de minimis entries for all three countries, which will have broad impacts on many businesses and industries, said Tim Brightbill, co-chair of Wiley Rein’s trade practice. “The de minimis provisions have been abused by a variety of importing industries – a problem well recognized by Congress as well as the current and prior Administrations.” While suppliers in China and criminal gangs in Mexico have been long accused of trafficking fentanyl into the United States, Trump’s tariff order against Canada included a long preamble saying that drug trafficking from Canada is growing. “The challenges at our southern border are foremost in the public consciousness, but our northern border is not exempt from these issues,” the order reads. “Criminal networks are implicated in human trafficking and smuggling operations, enabling unvetted ******** migration across our northern border. There is also a growing presence of ******** cartels operating fentanyl and nitazene synthesis labs in Canada.” Nitazenes are similar to fentanyl. The order added that drug trafficking via the de minimis exemption “has created a public health crisis in the United States.” SHIPMENTS GROW De minimis shipments into the United States have grown significantly since 2015, when the threshold for duty-free treatment was raised to $800 per shipment from $200 previously. The U.S. Customs and Border Protection agency now estimates that it process more than 1 billion such shipments per year, and Census Bureau data shows that estimated low-value shipments were the eighth-largest U.S. import category from China at $4.7 billion in 2023, more than doubling since 2014. Former President Joe Biden’s administration in January issued last-minute proposed rules to curb the de minimis exemption globally, denying it to goods under other punitive tariff orders, and requiring shippers to identify the package contents by their 10-digit tariff codes. It is unclear if Customs and Border Protection, now under Trump’s direction, will act to finalize that rule. The South Dakota Republican’s state could be hammered by tariffs. South Dakota’s largest market is Canada, representing 44 per cent of total exported goods from the agriculture state. It also imports USD $686 million in goods from Canada annually, including fertilizer and machinery. Mexico is the state’s second largest market. While many Republicans remained mum, Sen. Rand Paul of Kentucky was among the exceptions. He posted on social media that “tariffs are simply taxes.” “Conservatives once united against new taxes. Taxing trade will mean less trade and higher prices,” Paul said. The Railroad District, a historic area of downtown settled by ****** residents, was one of six areas the Board of Aldermen included in urban renewal districts that the city declared “slum or blighted” so the areas would qualify for federal funds for redevelopment. The lawsuit, filed in U.S. District Court in Gulfport, contended the city should have notified each property owner before taking the action U.S. District Judge Taylor McNeel ruled Friday that the action was legislative and required no individual notice. He also noted the residents prevailed in the end. The urban renewal map included 131 parcels spanning 320 acres in different parts of the city. Railroad District residents said they were blindsided and unable to protect their property rights before the city declared their properties slum or blighted. They feared the city would use the blighted designation to take their properties through eminent domain for redevelopment. Downtown Ocean Springs, where a mix of businesses and homes have long co-existed, has been undergoing rapid growth and reconstruction. When Railroad District property owners learned about the urban renewal plan and slum designation after the vote, they mobilized opposition. They filed their lawsuit in October 2023. They were joined by a a commercial property owner on Bienville Boulevard. In November 2023, the city rescinded its vote on slum and blight designations for urban renewal. Aldermen shrunk the urban renewal area to two downtown properties, one owned by the city, and the other a neighboring private property that was once home to an optics manufacturing plant. The city wants to see a hotel developed on the property but contamination from the manufacturing plant has complicated development prospects. The city also asked for sanctions against the plaintiffs, claiming their lawsuit was frivolous. On Saturday, Trump signed an executive order that imposes a 25 per cent tariff on ********* goods entering the U.S., including a 10 per cent tariff on oil and gas. In a press release sent just hours after the tariffs were confirmed, Houston said that as of Monday, tolls at the Cobequid Pass will double for commercial vehicles entering from the U.S. He said the Nova Scotia Liquor Corporation will be directed to remove all U.S. alcohol from store shelves effective this Tuesday. That totals more than 400 products, including beer, wine, spirits and coolers. For the 2023-24 fiscal year, sales of U.S. products imported from the U.S. totalled $18 million of the NSLC’s $753 million in sales on alcohol, said a liquor corporation spokesperson. These products made up seven per cent of the NSLC’s number of alcohol listings. Business deals with the U.S. will also be curtailed. “We will look for opportunities to cancel existing contracts and will maintain the option to reject bids outright because of President Trump’s unlawful tariffs.” Houston also said the province will limit access for provincial procurement for American businesses. He said going forward the province will focus on “finding new markets here at home with programs like Nova Scotia Loyal, focus on developing our own resources, eliminate inter-provincial trade barriers and, finally, of course, look for international diversification.” The statement also said it’s remarkable to “find ourselves at odds with our best friend and neighbour.” Federal government plans The province’s actions came ahead of the response outlined by the federal government. To start, Canada will slap 25 per cent tariffs on $30 billion worth of American goods coming into Canada as of Tuesday. The tariffs will then be applied to another $125 billion worth of American imports in three weeks’ time. Effect on farmers Alicia King, president of the Nova Scotia Federation of Agriculture, runs a seventh-generation farm with her husband in Antigonish, N.S. She said the biggest export impact will be felt by apple, blueberry, Christmas tree and beef cattle farmers. “Those would be a few that rely quite heavily on the U.S. export market,” she said. “They’re one of our largest trading partners and it’s an easy market access for us to get. We’re neighbours.” King is encouraging people to support local farmers whenever they can. Besides shopping at farmers’ markets and checking product origins at grocery stores, people can also stop by farm stands or join community-shared agriculture programs. Max Dixon, 16, and Mason Rist, 15, were stabbed outside Mason’s home in Knowle West on 27 January 2024 by four teenagers, in a case of mistaken identity. Those who gathered at The Park Centre in Knowle at sunset on Sunday let off balloons with messages for the best friends and wishes for a better future. Leanne Ekland, Max’s mum, said the “amazing” support the families have received since the boys’ deaths has made things “a little bit easier”. Gail Iles, Mason’s grandmother, and Nikki Knight, Mason’s mum, were both at the balloon launch [BBC] On Saturday, trees were planted in memory of Max and Mason, and their school, Oasis Academy, also paid tribute to them, Mason’s mum, Nikki Knight, told the BBC. “It’s still fresh, something you never get over,” she said. “Unfortunately, the incident was outside my house… I’m still in the house. “It’s very traumatic being there.” Mason (left) and Max (right) were going to get pizza together when they were fatally stabbed [PA Media] Five people – Antony Snook, 45, Riley Tolliver, 18, Kodi-Shai Wescott, 17, and two boys aged 15 and 16 who cannot be named due to their age – were detained for life in November and December for the murders. Bailey Wescott, 23, of Whitchurch, and Jamie Ogbourne, 27, of Hartcliffe, were also jailed in December for five years and three months after each admitting two counts of assisting an offender. Marcus Williams, 31, from Hartcliffe, along with Dominic Smith and Ellie Maddocks, both 25 and living in Westbury-on-Trym, appeared before Bristol Magistrates’ Court on 7 January, accused of helping three of the killers by driving them to an unknown address. They will appear at Bristol Crown Court on 10 February. Max’s mum and sister were among those at the gathering on Sunday [BBC] Max’s mum, Leanne Ekland, said the support of the community had “really helped” her family in the wake of the boys’ deaths. “There’s no answers, there’s no closure for us but hopefully we can turn this awful negativity into a huge positive and let Max and Mason’s name live on in a good way, instead of the way they were taken away from us,” Ms Eckland said. BBL organisers have long grappled with how to showcase the best of *********** Test talent during the hectic home summer. The league introduced its supplementary list scheme two years ago to allow Test players to make cameos, with Steve Smith, Sam Konstas and Usman Khawaja among those doing so in this past tournament. But the league has gone five summers without featuring any of the “big-three” Test pacemen of Starc, Pat Cummins and Josh Hazlewood, who have used the late-January window for valuable rest. Hazlewood and Cummins nursed injuries this BBL summer, with Starc taking a 10-day break to relax between the India series and his flight out for the ongoing Sri Lanka tour. Starc played the last of his 10 BBL games for the Sydney Sixers in the summer of 2014/15. The 35-year-old can expect a similarly quick turnaround between international duties next home summer.
