He has slapped import duties against allies and adversaries alike, and raised their rates to staggeringly high levels, only to change his mind and abruptly pause or reduce the charges. Markets and global leaders have scrambled trying to guess his next moves, while major retailers have warned of rising prices for American consumers and potentially empty shelves in shops. The president has claimed this power to impose tariffs unilaterally. He says that as president he is responding to a national economic emergency – and he cannot wait for Congress to pass legislation. In effect, this meant his finger was constantly poised on one of the most effective triggers of US economic policy. Firing off a threatening missive to a country playing hardball was as easy as posting on Truth Social (just ask the European Union, which he called “very difficult to deal with” in negotiations last week). However, late on Wednesday, the US Court of International Trade ruled that he had exceeded the authority of the emergency powers he was using. The court gave the White House 10 days to remove almost all tariffs, which it says have been imposed illegally. The White House appealed, and a federal appeals court has stayed the trade court’s ruling, which means that those tariffs will stay in place – for now. The administration argued in its appeal that a ruling against Trump “would kneecap the president on the world stage, cripple his ability to negotiate trade deals, imperil the government’s ability to respond to these and future national emergencies”. On Thursday night, Trump was back on Truth Social, rebuking the lower court judges who had ruled against him, calling their decision “wrong” and “horrible”. Until now, the power to make or break the economy has rested on his shoulders, as the tariff rates levelled against other countries keep going up and down – seemingly according to Trump’s mood. He raised the tariffs on imported ******** goods all the way up to 145% before dropping them down to 30%. A few weeks later he used a social media post to threaten the EU with 50% tariffs, before backing down a couple of days later. Wall Street analysts have even reportedly now coined the phrase “Taco trade”, referring to their belief that Trump Always Chickens Out from imposing steep import taxes. He looked furious when asked about the acronym in the Oval Office on Wednesday. “That’s a ****** question” he said, arguing that it was only by making these threats that he got the EU to the negotiating table. Watch: Trump slams “Taco” acronym given to tariff flip-flops Trump’s ambassador to the EU during his first term, Gordon Sondland, told the BBC this so-called wishy-washy-ness was by design. “What Trump is doing is exactly what he would do as a business person. He would immediately find a point of leverage to get someone’s attention today. Not next month, not next year… he wants to have these conversations now,” he said earlier this week, before the latest legal twists. “How do you get someone as intransigent and as slow moving as the EU to do something now? You slap a 50% tariff on them and all of a sudden the phone start ringing.” If Trump’s tariffs plan continues to meet resistance in the courts, one option at his disposal is asking Congress to legislate the taxes instead. But that would eliminate one of his biggest tools – the element of surprise. For decades, Trump has been convinced that trade tariffs are the answer to many of America’s economic problems. He has appeared to welcome the prospect of global trade war sparked by his tariff agenda, insisting that it is by raising the price of imported goods and reviving the US manufacturing sector that he will “Make America Great Again”. Trump touts the money – billions of dollars, not trillions, as he says – that tariffs have already brought in to US government coffers. The president argues they will help to revive American manufacturing by persuading firms to move their factories to the US to avoid import duties. However, University of Michigan economics professor Justin Wolfers described Trump’s methods as “madness”. “If you believe in tariffs, what you want is for businesses to understand that the tariffs are going to… be permanent so that they can make investments around that and that’s what would lead the factories to come to the United States,” he told the BBC. Prof Wolfers said while Trump “chickens out from the very worst mistakes” – citing his original ‘Liberation Day’ levies and the threat of 50% tariffs on the EU – he doesn’t backflip on everything. The president wants to keep 10% reciprocal tariffs on most countries and 25% tariffs on cars, steel and aluminium. “Yes, he backs off the madness, but even the stuff he left in meant that we had the highest tariff rate yesterday than we’d had since 1934,” Prof Wolfers said. All signs point to this being a fight that the Republican president won’t give up easily. “You can assume that even if we lose, we will do it another way,” Trump’s trade advisor Peter Navarro said after Thursday’s appeals court ruling. Fraudster made £550,000 selling fake ‘Scottish-grown tea’ Fraudster made £550,000 selling fake ‘Scottish-grown tea’ Balmoral A fraudster who tricked luxury hotels and stores into buying “Scottish-grown tea” that was grown abroad has been found guilty of a £550,000 scam. Thomas Robinson supplied high-end customers such as Edinburgh’s Balmoral Hotel and the Dorchester in London with varieties with names like Dalreoch White, Highland Green, Silver Needles and Scottish Antlers Tea. Trading as The Wee Tea Plantation, he claimed they had been grown on farmland in Perthshire. Instead, the tea had been imported, repackaged and then resold at hugely-inflated prices, Falkirk Sheriff Court was told. Robinson also defrauded genuine aspiring Scottish tea growers by selling them plants he claimed were grown in Scotland. The 55-year-old, who is also known as Thomas O’Brien or Tam O’ Braan, rented a former sheep farm near Loch Tay and began spinning “elaborate lies” to customers. Prosecutors said he created the “CV of a fantasist” – claiming among other things that he was a multi-millionaire, a polymer scientist, a former bomb disposal expert and had invented the “bag for life”. He also claimed to have developed a “special biodegradable polymer” that would make the tea plants grow in half the usual time. The court was told it looked like a ****** bin liner. Robinson’s false claim that “our Scottish grown teas come from gardens in our farming heartland in Perthshire and Dumfries and Galloway” was reprinted on the Balmoral Hotel’s Palm Court luxury tea menu. He boasted that tea he had supplied to London’s Dorchester Hotel was “the Queen’s favourite”. The media was also taken in with numerous stories appearing, including on the BBC News website and in a BBC podcast. Tim Bugler Robinson scammed both tea buyers and other aspiring Scottish tea growers The court heard that in reality Robinson had bought over a tonne of tea grown abroad and had it delivered to mailbox address in Glasgow, using a different company name to cover his tracks. One expert said a kilo of top tea from Africa could be sold for 100 times its cost if passed off as Scottish. Robinson claimed his tea plants had been grown from cuttings and seeds at Dalreoch Farm, at Amulree in Perthshire. When a buyer from the prestigious food store Fortnum and Mason’s wanted to visit he hurriedly bought in plants from a nursery in Sussex and put them on show. Between 2015 and 2016 he conned a dozen genuine tea growers in Scotland and one from Jersey by supplying them with 22,000 plants at £12.50 each. The court heard he had actually imported them from a horticulturist in Italy at three Euros each. Many of these plants died or failed to thrive. One grower from Dumfries and Galloway was told he could expect to harvest his first tea after a year and enjoy a yield of 100kg of top tea as well as 450kg of secondary leaf for blends. After battling for seven years, the grower was only able to harvest 100g of finished tea. Food standards probe The scam began to unravel in 2017 after Perth and Kinross Council started to check if he had a food processing licence. Eventually the food crime unit at Food Standards Scotland was called in and an investigation launched, headed up by a retired police inspector. Robinson denied the charges and claimed paperwork that would have proved his innocence had been destroyed in a flood. He said he was proud of his work and told the jurors: “I wanted to leave something that would stand in the history of tea.” After a three-week trial jurors took six hours to find him guilty of defrauding tea growers, hotels and tea companies of nearly £553,000 in total. He will be sentenced at a later date, and also faces proceedings under the Proceeds of Crime Act. The report produced by the Make America Healthy Again Commission, named after a movement aligned with Health Secretary Robert F. Kennedy Jr, was released last week. It said processed food, chemicals, stress and overprescription of medications and vaccines may be factors behind chronic illness in American children, citing some 500 research studies as evidence. Digital news outlet NOTUS reported the citation errors, saying on Thursday it found seven studies listed in the report’s footnotes that did not exist, along with broken links and misstated conclusions. White House spokesperson Karoline Leavitt told reporters that any citation errors were due to “formatting issues.” The government said it posted a corrected version of the report later on Thursday. “The substance of the MAHA report remains the same – a historic and transformative assessment by the federal government to understand the chronic disease epidemic afflicting our nation’s children,” the Department of Health and Human Services said. Katherine Keyes, an epidemiology professor at the Columbia University Mailman School of Public Health, was cited in the report as the author of “Changes in mental health and substance use among US adolescents during the COVID-19 pandemic,” which the report said was published in the medical journal JAMA Pediatrics. She said that neither she nor the named co-authors of the paper had written it. “It does make me concerned given that citation practices are an important part of conducting and reporting rigorous science,” she said. Psychiatry Professor Robert L. Findling did not author the article cited in the report as “Direct-to-consumer advertising of psychotropic medications for youth: A growing concern” in the Journal of Child and Adolescent Psychopharmacology, according to a spokesperson for Virginia Commonwealth University, where Findling is a professor. Kennedy has spent decades sowing doubt about the safety of vaccines, raising concerns within the scientific and medical communities over the policies he would pursue as health secretary. Since taking the role, he has fired thousands of workers at federal health agencies and cut billions of dollars from U.S. biomedical research spending. As the Guardian noted, Farbiarz’s ruling is the first one by a federal judge regarding the constitutionality of the president’s pursuit of deportation of any non-citizen deemed a peril to U.S. foreign policy. However, Farbiarz has yet to grant Khalil’s release as he claims his attorneys have yet to address another charge by the government: that Khalil didn’t include his personal affiliations to some organizations—namely, a United Nations agency that works with ************ refugees and a Columbia protest group. Why do faceless politicians have the power to strip human beings of their divine moments?” This week, Abdalla spoke publicly about navigating life after the birth of their first child as Khalil remains miles away. “I walked into the house by myself with this beautiful baby, and I think it just kind of hit me,” Abdalla told The Cut. “I have to do this alone.” “I rely on him a lot,” Abdalla added. “It was always a fear of mine that he was not going to come to the birth.” Still, she told the publication that she tried to maintain optimism that Khalil would be home before her water broke. Mohtasem Mahir Thabata, the owner of Moe’s Smoke Shop, is facing a ******* charge. According to a police report, officers arrived around 3 p.m. Wednesday to a shopping center near Lomas Blvd. and San Mateo Blvd. When they arrived, they found a burned car and a man, identified as Matthew Sedillo, on the ground with a bullet wound, where he soon after was pronounced dead on scene. Police eventually spoke to Thabata, who admitted to shooting at Sedillo, who he said stole two shirts and a glass ***** from his store, before trying to flee in a car. Thabata told police he was trying to shoot the tire, but instead, Sedillo was hit and killed. The car crashed into another vehicle in the Sprouts parking lot, then ended up across the street where it hit a curb and caught fire. Thabata told officers he was angry and that he doesn’t like violence, but he said Sedillo left him no choice. “At the end of the day, as frustrating as it can be, it’s just inventory. Most businesses, including ours, has insurance for that, and it’s never worth taking or risking your own life for just inventory,” said the anonymous employee. The total amount of stolen merchandise was $75. Thabata doesn’t have a significant criminal history in New Mexico. Matthew Sedillo was recently released from jail after being found incompetent. The rulings – which strike at the heart of Trump’s economic agenda – represent far more of a threat to his priorities, White House officials said, than many other court opinions over the last four months since Trump returned to office. And perhaps no fight will prove as consequential to the president’s agenda — at home and abroad — as the effort now underway by Trump and his administration to rescue his tariff policy after it was imperiled by a relatively obscure tribunal this week. The day after the US Court of International Trade — a panel housed in a boxy glass building in Lower Manhattan — ruled Trump lacked the authority to apply the sweeping sky-high tariffs under federal emergency powers, the president and his team quickly moved to have the ruling frozen. The administration blasted the Wednesday night decision, which was reached by a three-judge panel appointed by Trump, Barack Obama and Ronald Reagan. Trump’s team was successful; by Thursday afternoon, a federal appeals court in Washington had preserved the tariffs on an administrative basis, buying the White House time. In the interim, there was a scramble inside the White House to both identify other authorities that would allow Trump to move ahead with the stiff new duties and to swiftly petition the courts to pause enforcement. Back-up options could prove cumbersome. Many of the alternative routes would involve lengthy investigations or require approval from Congress, where support for tariffs — even among some Republicans — is lukewarm. “We’re not planning to pursue those right now because we’re very, very confident that this really is incorrect,” Trump’s top economist Kevin Hassett said early Thursday in a Fox Business interview, before affirming later in the day what other White House officials had been saying: that Trump’s team was exploring all its options. “Heaven forbid, if it ever did have trouble in the future, we’ve got so many other options on the table that the president’s policy is going to be there,” he told reporters in the White House driveway. Still, it seemed evident that Trump’s advisers believed the courts would provide the best resource, even if there was little certainty at how judges will ultimately rule. “We will respond forcefully, and we think we have a very good case with respect to this,” Trump’s hawkish trade adviser Peter Navarro said following the stay decision. The whiplash rulings — which joined a string of on-again, off-again tariff moves orchestrated by Trump himself — only seemed to emphasize the degree of chaos that continues to color Trump’s trade agenda. The tariffs were restored only temporarily, leaving foreign trade partners and investors in a state of limbo at least until June 9, the date by which the Justice Department must respond to those challenging the duties. The ultimate fate of Trump’s prized tariffs, both a lynchpin of his wider economic agenda and the motivating force of his foreign policy, has now been thrust into deep uncertainty. And the prospects of the roughly 18 trade deals that the administration has said are being negotiated under threat of withering new tariffs — including three in their final stages, according to White House officials — now appear unclear. The legal and trade fights, which are now fully intertwined, present one of the biggest challenges yet for the administration – further complicated by urgent efforts to push the Senate to advance its budget and tax bill. Taken together, Trump faces a multi-front battle that could well define his presidency. Trump lashed out at the judiciary in a lengthy Thursday evening Truth Social post, taking aim at the three judges from the Court of International Trade. “How is it possible for them to have potentially done such damage to the United States of America? Is it purely a hatred of ‘TRUMP?’ What other reason could it be?” Hours earlier, White House press secretary Karoline Leavitt had struck a similar tone, attacking “unelected judges” ahead of the stay decision. “America cannot function if President Trump, or any president for that matter, has their sensitive diplomatic or trade negotiations railroaded by activist judges.” Trump remained behind closed doors Thursday, but did hold a meeting with Federal Reserve chairman Jerome Powell, whom he has sharply criticized for not lowering interest rates. Powell has also expressed concern Trump’s tariffs could lead to higher inflation and lower economic growth. The president’s long-standing belief in tariffs has not been shaken, officials said, despite the series of legal, political and economic setbacks. While Trump has repeatedly argued that tariffs will make the United States wealthy, the counterargument that import taxes will be paid by consumers has made his sales pitch far more difficult. And businesses are begging for a sense of certainty and a consistent policy. It was a coalition of small business owners and 12 states that challenged the legality of the Trump tariffs before the US Court of International Trade. “We brought this case because the Constitution doesn’t give any president unchecked authority to upend the economy,” Oregon Attorney General Dan Rayfield said in a statement. “We’re very confident in our case,” said Jeffrey Schwab, a senior counselor at the Liberty Justice Center, which represented the small business owners who filed suit. “The Trump administration is asserting a vast unilateral authority that is not supported in the law.” As for the uncertainty abroad, Treasury Secretary Scott Bessent argued Thursday night that trade negotiations with international partners haven’t been affected. “They are coming to us in good faith and trying to complete the deals before the 90-day pause ends,” he told Fox News. “We’ve seen no change in their attitude in the past 48 hours. As a matter of fact, I have a very large Japanese delegation coming to my office first thing tomorrow morning.” But some US trading partners tread cautiously in their response. “We will study this ruling of the US Federal Courts on reciprocal tariffs closely and note that they may be subject to further legal processes through the courts,” said Australia’s trade minister Don Farrell, who was careful not to get ahead of ongoing judicial review. “You will have to bear with us,” said a spokesman for India’s Ministry of External Affairs when questioned about the court ruling. India remains in intensive discussions with the Trump administration on a trade deal.
