The Nasdaq’s afternoon tumble Thursday pushed it to its 200-day moving average for the first time since the summer. The tech-heavy index is also at its most oversold RSI levels since August, and CNN’s Fear & Greed Index (a contrarian stock market indicator) sank from Neutral (47) a week ago to Extreme Fear (22).

ServiceNow’s earnings estimates dipped slightly after its Q4 release on January 29, contributing to NOW’s drop. Still, the tech firm is projected to grow its revenue by 19% in 2025 and 2026 to boost its earnings by 17% and 20%, respectively.

NOW shares climbed roughly 1,150% in the last 10 years to nearly quadruple the Zacks Tech Sector.
ServiceNow has cooled off in the last three years and its 22% drop from its January highs has it neck and neck with tech in the past 12 months. NOW is finding buyers at its 200-day moving average, with its 50-week the next line of support.

Vertiv is projected to grow its revenue by 15% in 2025 and 2026 after 17% average sales growth in the trailing three years. The picks and shovels tech stock is expected to boost its adjusted earnings by 26% and 24%, respectively.
VRT stock has ripped 490% higher in the past two years to top Nvidia’s 415%, with it up 690% in the last five years vs. Tech’s 135%. This performance includes Vertiv’s roughly 41% tumble from its peaks. At $92 a share, VRT trades around 43% below its average Zacks price target.

Vertiv is attempting to find buyers near its 50-week moving average while at its most oversold level over the past several years. Despite its long-term outperformance, Vertiv trades nearly in line with the Zacks Tech Sector at 26.5X forward 12-month earnings. VRT’s impressive long-term earnings growth outlook helps the stock trade at a 44% discount to Tech, with a 0.9 PEG ratio.

World’s first nuclear fusion power plant in US close to historic ignition test
Helion Energy, an Everett-based fusion energy company, has announced plans to construct the world’s first fusion power plant in Malaga, Washington.
The company is working towards developing a 50-megawatt fusion power plant on land owned by the Chelan Public Utility District (****) near Rock Island Dam, along the Chelan County side of the Columbia River.
While the site has not been officially finalized yet, discussions are progressing, and the company plans to further engage with the community for this pioneering project.
Helion’s nuclear mission
The announcement was made during a joint press conference at the Confluence Technology Center in Wenatchee. The public event featured Helion Communications Director Jessie Barton, Chelan ****’s Kirk Hudson, Chelan County Community Development Director Deanna Walter, and Jim Kuntz of the Chelan Douglas Regional Port Authority.
They discussed their respective agencies’ roles in exploring the potential for carbon-free energy sources in Chelan County.
“We’re looking at developing a 50-megawatt fusion power plant on ****-owned land, near Rock Island Dam, on the Chelan side of the Columbia River,” said Barton. “Now, this isn’t an official site selection at this point, but we are at the point where we’re ready to bring in more community members and have a larger conversation about this potential project.”
A community event is planned for March 11 at Mission View Elementary School, where additional details about the project will be shared. The company has set an ambitious timeline, aiming to begin construction this summer if the permitting process proceeds without delays, to generate fusion energy by 2028.
Chelan ****’s Vision for Future Energy Diversification
From Chelan ****’s perspective, this project is a key component of a broader strategy to meet future energy demands and expand beyond hydropower, which has traditionally been the region’s primary energy source. “We have all of our eggs in one basket with hydropower, which has served us very well, but the future is going to be much different than the past has been,” said Chelan ****’s Kirk Hudson.
Initially, the fusion energy produced will support a purchase agreement with Microsoft, with long-term plans to make this clean energy accessible to local customers.
The **** remains optimistic about the project’s growth and success, aiming for its benefits to extend to residents of Chelan County and the broader north-central Washington region.
Formal discussions regarding agreements with Helion, including potential lease terms, are expected once the company is ready to begin construction.
Helion Energy anticipates hiring approximately 130 workers during the initial construction phase, with around 30 staff needed for ongoing plant operations once the facility is complete.

(Reuters) – U.S. Health Secretary Robert F. Kennedy Jr. on Friday said he recognizes the serious impact of the current measles outbreak in Texas, in which a child died this week, and said the government is providing resources, including vaccines.
“Ending the measles outbreak is a top priority for me and my extraordinary team,” Kennedy said in a post on X. The secretary, who has for years sown doubts about the safety and efficacy of immunization, said the Department of Health and Human Services would send Texas 2,000 doses of the measles, mumps and rubella vaccine through its immunization program.
Earlier, the U.S. Centers for Disease Control and Prevention upheld the role of vaccines in offering protection against measles after an unvaccinated child died from an infection this week. The death, reported on Wednesday, was the first U.S. fatality from the highly contagious disease in a decade. Government data showed a growing outbreak with more than 140 cases reported in Texas since late January.

The child’s death and the hospitalization of nearly 20 other patients in Texas have put Kennedy’s vaccine views to the test.
Kennedy founded the anti-vaccine group Children’s Health Defense. However, he has denied being “anti-vaccine” and has said he would not prevent Americans from getting vaccinated.
A total of 164 measles cases were reported as of February 27, of which about 95% were from unvaccinated people, while 3% were from people who received only one of the two required shots for immunity, CDC data showed on Friday.
These cases were reported in nine jurisdictions, including Kentucky, marking a near 80% jump from 93 cases reported a week ago.

DALLAS – Two people knocked over “multiple poles” during a fight causing a loud noise and panic inside the Kay Bailey Hutchison Convention Center Saturday afternoon, Dallas police said.
What we know
The convention center is hosting the NCA All-Star National Championship this weekend.
In a statement, Dallas police said the noise of the poles being knocked down caused a panic inside the building and people to start rushing outside “in a stampede.”
Authorities said no shooting occurred.
Video sent to FOX 4 shows several people running from the area.
The rush of people caused multiple non-life-threatening injuries as a result of the chaos, police said.
Dallas police set up a family reunification center at 400 Lamar Street.
The incident prompted the National Cheerleaders Association to cancel the rest of Saturday’s event.

Varsity Brands, the company behind the NCA, released the following statement about the incident:
“Earlier today, the Kay Bailey Hutchison Convention Center was evacuated as a precaution based on reports of a safety concern. NCA security officials immediately began working with the Dallas Police Department to quickly investigate, which found that the incident was triggered by an altercation between two attendees, which led to panic and multiple non-life-threatening injuries in the aftermath. We want to thank the Dallas Police Department for their help assessing and controlling the situation as well as the first responders who assisted those impacted.
“As a precaution, we suspended activities for today and will continue to work with event staff and local authorities to ensure a safe environment for our athletes to finish competing when we resume tomorrow.”

Police have not said if anyone was arrested for the fight.
The NCA has not announced a revised schedule for the events that were canceled Saturday afternoon.

The love life of South Africa’s Zulu king has the country agog – and has scandalised his socially conservative subjects as he messes with tradition by seeking a divorce.
Polygamy is part of Zulu culture, but King Misuzulu kaZwelithini has taken the unusual step of going to court to divorce his first wife, Queen Ntokozo kaMayisela.
“Everyone was puzzled. People were not expecting the king to go so far as to file for divorce,” Prof Gugu Mazibuko, a cultural expert at South Africa’s University of Johannesburg, told the BBC.
“In Zulu culture, there is no divorce. You are not supposed to chase away your wife,” she said.
Regarded as the “lion of the nation”, the Zulu king is the custodian of age-old traditions that place marriage and polygamy at the heart of royal success.
His role within South Africa may only be ceremonial, but he remains hugely influential, with a yearly government-funded budget of several million dollars.
The monarch – who grew up in neighbouring Eswatini, studied in the US and came to the throne in 2021 – seems to court controversy.
His coronation was challenged in court by his elder half-brother, who has been trying to snatch the crown from him.
His second marriage appears to be shaky, his attempt to take a third wife hit the buffers and there are also reports of another dalliance with a young princess.
However, the 50-year-old’s troubled personal life used to be discussed in hushed tones – that is until he filed divorce papers in December.
Prof Mazibuko acknowledged one Zulu monarch in the 20th Century had divorced one of his queens, but it had been a “top royal secret”, given royal divorce is not the norm.
“If a marriage does not work out, the wife will still live in the king’s homestead. She will be given her own space. She will not have a relationship with the king, but she and her children will be well-cared for.”

It was just before his accession to the throne – following the sudden death of his father and mother four years ago – that the then-Prince Misuzulu married Ntokozo Mayisela.
The two were already a couple and had two children together, but according to another cultural expert, Prof Musa Xulu of the University of Zululand, the decision to marry appeared be be hurried.
“It seems as though he felt he could not be a king without a wife,” he told the BBC.
Queen kaMayisela came from an “ordinary family” – as many of the wives of Zulu kings do – in a small mining town in KwaZulu-Natal province.
It was as a cabaret singer performing at a restaurant in the coastal city of Durban that she caught the royal eye, the academic said.
Her senior status in the family was made clear at the king’s state coronation in December 2022 when she sat by his side.
But her position is now under threat, with the monarch saying in court papers that they have not lived as husband and wife for at least year and their marriage has irretrievably broken down.
The palace followed this by sending out invitations for the king’s wedding to a new bride, Nomzamo Myeni, set to take place in late January. The bride-price, known as lobola, had already been paid in cattle – a prized asset in Zulu culture.
Queen kaMayisela did not take any of this lying down, instituting separate court action to halt the wedding, which was postponed as a result.
Her argument was that the king – known to his subjects as “Ingonyama”, meaning Lion – would be committing the offence of “bigamy” without first “converting” his civil marriage to her into a traditional Zulu marriage.
But the judge threw out her case, saying she had had a “turnaround” in attitude as she had already agreed her husband could take other wives.
He noted the monarch had already done so – marrying Nozizwe kaMulela, the MD of Eswatini Bank, in 2022.

Prof Mazibuko explained that polygamy was not initially part of Zulu culture, in fact the first two kings were bachelors.
But it was embraced by their successors – King Misuzulu is the ninth monarch of the Zulu nation – as a way of building allies.
Queen kaMulela comes from an influential family in Eswatini and the marriage was apparently arranged to strengthen the ties between the royal families.
Yet it is unclear whether the pair are still in a relationship, as the high-powered banker has not been spotted at Zulu cultural events for a while – with speculation their final marriage rituals have not been completed.
The current king’s various marriage problems seem to stem from the fact that tradition has not been properly followed.
In the case of the first wife, he opted for a modern-day marriage, without a traditional wedding.
“For a marriage to be perfected under Zulu custom, there has to be a public gathering, with song and dance,” Prof Xulu said.
“You, as the bride, must lead with a solo song and the bride-maids dance with you, and you carry a spear which you give to the king – and then there is no going back.”

This has left Queen kaMayisela without the protection of tradition – and only the offer of monthly maintenance of $1,100 (£850) for a year, though she was likely to demand more before returning to the life of a commoner, Prof Xulu said.
In the case of the second wife, the academic said lobola had been paid in January 2022, but royal insiders suggest the king felt “those who went to pay didn’t have the authority to do so” – plus this union has not been marked with a public ceremony.
The fortunes of the would-be third wife, Nomzamo Myeni, remain unclear as the king failed to marry her in January despite the court giving the go-ahead.
Prof Xulu said that in Zulu culture a “postponed” marriage usually never takes place.
Though Ms Myeni is still being seen with the king, accompanying him to a state event last week where she was referred to as a queen, suggesting their wedding may take place once the king’s divorce goes through.
Yet as a commoner she would bring no powerful connections with her, which may be why one of the monarch’s aides recently confirmed to local media there was “a new queen-to-be” – Sihle Mdluli, who hails from the royal family of a small ethnic group in South Africa.

The aide suggested she might be named “the mother of the nation” – a title that would make her the most senior queen with her children likely heirs.
But Prof Xulu said he would not be surprised if that wedding also failed to take place, as the king’s relationships all seemed to run into trouble.
“I am not sure whether he was ready to be king, and whether he has good advisers,” the academic said.
He pointed out that the monarch had also been behaving erratically in his public life, sacking several senior officials in his retinue.
On top of this, he has installed himself as the chairman of the board of a financially lucrative land trust, of which he is the sole trustee.
The trust was controversially established shortly before South Africa became a democracy in 1994, giving it control of about 2.8 million hectares (seven million acres) of land in KwaZulu-Natal.
King Misuzulu has also suspended all members of the board, bar one, accusing them of being uncooperative.
He did this against the advice of the government, which pointed out that as chairman he would be required to account to parliament about the trust’s operations – something that would not be in keeping with his status as a constitutional monarch.
The dispute remains unresolved, giving the government a major political headache as it tries to avoid going head-to-head with the king.

Prof Xulu said he would not be surprised if at some point a powerful rival faction within the royal family launched a fresh bid to dethrone him by asking the courts to rule that he is not “fit and proper” to be king.
The monarch’s half-brother, Prince Simakade Zulu, who is the late king’s eldest son, has long coveted the crown, but his backers were outmanoeuvred by Misuzulu’s allies in succession discussions.
President Ramaphosa later gave Misuzulu a “certificate of recognition”, paving the way for him to be funded by the government.
But Prince Simakade’s supporters did not give up – going to the High Court to declare his state coronation “unlawful” – and won.
The court ruled that President Ramaphosa had failed to comply with the law, which required him to order an investigation into objections to Misuzulu’s accession.
The status quo remains, pending the outcome of an appeal.
The scandals over King Misuzulu’s private life – especially his divorce – have the potential to weaken his position should it come to another tussle for the crown.
Though Prof Mazibuko noted there had always been fierce competition for the Zulu crown – except these days it takes place in court instead of a bloody battlefield.
“He is not the first king to go through a lot,” she said. “I hope he survives, and everything settles down.”

One of the top reasons investors should consider buying American Express is its wide economic moat. This means the company possesses sustainable competitive strengths that allow it to keep rivals at bay.
One area to pay attention to is Amex’s powerful brand, which holds tremendous value in the financial services industry. It offers premium credit cards that often come with high annual fees and impressive perks and rewards, which attracts a more affluent customer base. These people generally have greater spending power, making Amex a partner of choice for various airlines and hotels, for example.
As of Dec. 31, there were 146 million American Express cards active across the globe. These are accepted by about 90 million merchants worldwide. At a high level, this two-sided platform creates a network effect in which more users on each side immediately increase the value Amex provides. This setup is virtually impossible for anyone else to replicate.
Besides the company’s durable competitive advantages, investors will also appreciate American Express’ growth trajectory. Payment volume and revenue continue to increase at healthy rates. It’s worth pointing out that Gen-Z and Millennial consumers are registering faster spending growth than older generations. The business is doing a great job of bringing on these younger consumers, which bodes well for future success as their spending power increases over time.
Generating profits also isn’t a problem. The business put up a net profit margin of 15% in 2024. Operating a scaled platform can be very lucrative. What’s more, Amex has figured out how to approve customers and take on credit risk in a very profitable manner. This is demonstrated by its industry-leading charge-off rate.
As previously alluded to, American Express is a wonderful business. Even the great Warren Buffett thinks so, as Berkshire Hathaway remains a large shareholder. However, this doesn’t mean investors should immediately rush to buy the stock.

There’s one clear reason to be bearish right now. That’s the valuation.
As of this writing, the stock trades at a price-to-earnings (P/E) ratio of 21.1. This represents a premium to the trailing five- and 10-year averages, and it has climbed notably in the past several months. It’s clear that the market has become more bullish on the business, which makes sense given its strong financial performance.
Some investors might not think the valuation is a deal-breaker. After all, this is an outstanding company with a wide moat and impressive long-term revenue and profit growth. That means the stock deserves a closer look at the minimum.
However, I adopt a totally different perspective. My investing strategy centers on finding stocks that I believe can outperform the broader S&P 500 over the next three to five years. To its credit, Amex has done exactly this in the past three and five years.
However, the current valuation looks too rich to me. And this prevents me from wanting to initiate a new position in the stock. Maybe if the P/E multiple contracted toward the mid-teens level, I’d be much more interested in buying shares.

Josh Dunkley insists his headstrong Brisbane Lions side won’t stop dancing just because the ice has thickened in their AFL premiership defence.
Brisbane will launch their season against Geelong at the Gabba on Thursday, 159 days after reaching the peak in a dominant grand final defeat of Sydney.
That MCG thrashing completed an incredible campaign from a side that had climbed back from 13th position to finish fifth, then recover from 44 and 25-point margins to reach the decider.
At their lowest ebb, coach Chris Fagan told the group that “if you’re on thin ice, you may as well dance”.
It was a saying that resonated and became the theme of their triumph.
A relatively fluent pre-season has followed and midfield workhorse Dunkley is confident his men can continue that brave approach now they’re back on firm ground.
“Mentality is a choice and we have a choice,” he told reporters on Sunday after training.
“The last few years we’ve been a really good side, so there’s no reason why this year the mentality changes, just because we won a premiership.
“It’s all about the present and being in the right frame of mind.
“And we’ve preached the right message to the boys this year and are not looking any further than this week.
“If you think that it’s easy, then it won’t happen.”
Closely beaten in the 2023 decider, the Lions aim to snap the modern AFL trend that’s seen premiers struggle to back up.
Collingwood last year became the fourth reigning premiers to miss the finals in the last eight seasons, with Richmond’s three-peat in between the outlier and Dunkley’s Western Bulldogs kickstarting the pattern in 2017.
“That was a long time ago, my second season,” he said on Sunday of the Bulldogs’ 2016 crown.
“We have talked about it, knowing a few sides have been through it.
“But it’s just on us. It’s our responsibility; everyone here at the club wants to get to where we got to last year again and that starts this week.”
Harris Andrews trained fully after missing Thursday’s pre-season game due to illness, while Lachie Neale, Jack Payne, Eric Hipwood, Callum Ah Chee, Hugh McCluggage and Lincoln McCarthy were on light duties but expected to train in Tuesday’s main session.
Defender Brandon Starcevich (concussion) is the only confirmed non-starter on Thursday from those not already on the longer-term injury list, with draftee Levi Ashcroft firming for his AFL debut.

Archaeologists in China have discovered a 2,800-year-old fortified wall that predates the country’s first emperor.
The wall, which runs through a narrow mountain pass in the eastern province of Shandong, was first constructed in around 800 B.C. At that time, it was about 33 feet (10 meters) wide. But it was expanded during the Warring States ******* (circa 475 to 221 B.C.) to be about 100 feet (30 m) wide, the ******** news outlet Global Times reported.
The archaeologists also found the remains of houses, roads and trenches nearby. The team discovered the wall’s age by radiocarbon-dating animal bones and plant remains from the same layer.
The Global Times, among others, said that this pushes back the construction of the Great Wall of China back by 300 years. However, experts that Live Science contacted disputed this. (Live Science reached out to the Global Times for comment, but it did not respond by the time of publication.)
This newly found wall “is, of course, not ‘the Great Wall of China,'” Gideon Shelach-Lavi, a professor of Asian Studies at the Hebrew University of Jerusalem, told Live Science in an email. The newfound wall was built at a time when China was divided into a number of different states that were often at war with each other. Shelach Lavi noted that the different states often constructed walls during these conflicts.
One of these walls is called the “Great Wall of Qi,” also known as the “Long Wall of Qi,” which runs east-west through Shandong province, roughly from Pingyin county to the Pacific Ocean. The exact length of the wall is unclear, but it would have been more than 200 miles (322 km).

But the newfound fortification is not part of the Great Wall of Qi, either, as that was built later, in around 441 B.C., Yuri Pines, a professor of Asian Studies at the Hebrew University of Jerusalem, told Live Science.
Pines called the newly unearthed wall a “very important” discovery and noted that it is at a narrow mountain pass that could have been used to invade the state of Qi. The new find suggests that there was a permanent garrison at the pass, likely made up of Qi soldiers, and that they built a narrow wall to try to block the pass.
“That the garrison tried to wall the narrow pass northward is indeed very interesting,” Pines said. “But this is not a Long Wall, surely nothing on a par with the subsequent effort.” While the newly discovered wall fortified a single narrow mountain pass, the Long Wall of Qi ran for more than 200 miles.
Live Science contacted archaeologists who discovered the 2,800-year-old wall remains but has not heard back at time of publication.

The wall protected Qi from invasions by other states south of the wall. While its exact route is unclear it ran east-west through Shandong province.
Construction of the Great Wall of China started during the reign of the first emperor of China, Qin Shi Huang, who ruled from around 221 to 210 B.C. The wall was later modified and renovated during the Ming dynasty (1368 to 1644) UNESCO reports. It was built to protect China from nomadic groups that lived north of China.
When he started construction of the Great Wall, the first emperor made use of earlier walls built by the different states — including the Great Wall of Qi — and connected parts of them together to help build the Great Wall of China, UNESCO notes.

US Secretary of State Marco Rubio says he has signed a declaration to expedite delivery of approximately $US4 billion ($A6.4 billion) in military assistance to Israel.
The Trump administration, which took office on January 20, has approved nearly $US12 billion ($A19 billion) in major foreign military sales to Israel, Rubio said in a statement on Saturday.
The US “will continue to use all available tools to fulfill America’s long-standing commitment to Israel’s security, including means to counter security threats”.
Rubio said he had used emergency authority to expedite the delivery of military assistance to Israel to its Middle East ally, now in a fragile ceasefire with ****** militants in their war in Gaza.
The Pentagon said on Friday that the State Department had approved the potential ***** of nearly $US3 billion ($A4.8 billion) worth of bombs, demolition kits and other weaponry to Israel.
The administration notified Congress of those prospective weapons sales on an emergency basis, sidestepping a long-standing practice of giving the chairs and ranking members of the House Foreign Affairs and Senate Foreign Relations Committees the opportunity to review the ***** and ask for more information before making a formal notification to Congress.
Friday’s announcements marked the second time in recent weeks that President Donald Trump’s administration has declared an emergency to quickly approve weapons sales to Israel.
The Biden administration also used emergency authority to approve the ***** of arms to Israel without congressional review.
On Monday, the Trump administration rescinded a Biden-era order requiring it to report potential violations of international law involving US-supplied weapons by allies, including Israel. It has also eliminated most US humanitarian foreign aid.
The January 19 Israel-****** ceasefire agreement halted 15 months of fighting and paved the way for talks on ending the war, while leading to the release of 44 Israeli hostages held in Gaza and around 2000 ************ prisoners and detainees held by Israel.
Hours after the first phase of the agreed ceasefire was set to expire, Israel said early on Sunday it would adopt a proposal by Trump’s envoy, Steve Witkoff, for a temporary ceasefire in Gaza for the Ramadan and Passover periods.
Israel and ****** have accused each other of violating the ceasefire, casting doubt over the second phase of the deal meant to include releases of additional hostages and prisoners as well as steps toward a permanent end of the war.

(Reuters) -Spirit AeroSystems reported a $577 million fourth-quarter operating loss on Friday, swinging from $215 million in operating income a year earlier, which was helped by a funding agreement with key customer Boeing.
The major supplier to the U.S. planemaker reported $2.1 billion in net losses for 2024, and it “will need to obtain additional funding to sustain operations, as we expect to continue generating operating losses for the foreseeable future,” the company said in its earnings announcement on Friday.
Its two key customers — Boeing and European rival Airbus — already agreed in the fourth quarter to provide cash infusions: $350 million in advance payments from Boeing and up to $107 million in non-interest bearing credit from Airbus. In November, Spirit warned that there was “substantial doubt” it would be able to continue as a going concern.
Boeing is in the process of acquiring its Wichita-based former subsidiary in a deal expected to close by mid-year, said President and CEO Pat Shanahan in a statement.
Spirit Aero reported free cash flow, a metric closely watched by investors, of $91 million during the quarter compared with $42 million a year earlier. Revenue declined 9% to $1.65 billion during the quarter.
Spirit, which produces aerostructure parts for both Boeing and Airbus, said its deliveries were up on models for both planemakers during the quarter.
“Deliveries were up twofold on the 737, 37% on the A220 and 15% on the A350 compared to the prior quarter,” said Chief Financial Officer Irene Esteves in a statement.
“We believe this progress demonstrates that, with the right customer support, we are able to meet current demands while also investing for future production rate increases.”
The company did not give guidance for 2025, but it expects “significant reductions” in projected revenue and cash flows for the year due to production changes at Boeing, lower than planned 737 production rates and no price increases on Airbus programs, the announcement said.
The fourth quarter losses include net forward losses of $440 million — $167 million on its Boeing 787 program, $73 million for Airbus’ A220 and $64 million on its Airbus A350 program — due to production performance issues and higher labor and supply chain costs.

The head of a federal watchdog agency must remain in his job, a judge in Washington ruled on Saturday, saying President Trump’s bid to remove the special counsel was unlawful.
U.S. District Judge Amy Berman Jackson sided with Hampton Dellinger, who leads the Office of Special Counsel, in a legal battle over the president’s authority to oust the head of the independent agency that’s likely headed back to the U.S. Supreme Court.
Dellinger sued Trump last month after he was fired, even though the law says special counsels can be removed by the president “only for inefficiency, neglect of duty, or malfeasance in office.” Jackson, who was nominated to the bench by Democratic president Barack Obama, quickly reinstated Dellinger in the job while he pursued his case.
Jackson rejected the Trump administration’s claims that the special counsel’s removal protections are unconstitutional because they prevent the president from rightfully installing his preferred agency head.
The judge said allowing the president to remove the special counsel at will would have a chilling effect on his crucial duties, which include guarding the federal workforce from ******** personnel actions, such as retaliation for whistleblowing.
“The Special Counsel is supposed to withstand the winds of political change and help ensure that no government servant of either party becomes the subject of prohibited employment practices or faces reprisals for calling out wrongdoing — by holdovers from a previous administration or by officials of the new one,” Jackson wrote in her decision.
The Justice Department quickly filed court papers indicating it will challenge the ruling to Washington’s federal appeals court. The case has already gone up once to the Supreme Court, which previously temporarily allowed Dellinger to remain in his job.
The ruling comes as Dellinger is challenging the removal of probationary workers who were fired as part of the Trump administration’s massive overhaul of the government. A federal board on Tuesday halted the terminations of several probationary workers after Dellinger said their firings may have been unlawful.
“I’m glad and grateful to see the court confirm the importance and legality of the job protections Congress afforded my position,” Dellinger said in a statement on Saturday. “My efforts to protect federal employees generally, and whistleblowers in particular, from unlawful treatment will continue.”
The judge said the special counsel has a “unique status and mission,” which requires independence from the president to ensure he can carry out his responsibilities. The office investigates whistleblower claims of reprisal, can pursue disciplinary action against employees who punish whistleblowers and provides a channel for employees to disclose government wrongdoing.
“If I don’t have independence, if I can be removed for no good reason, federal employees are going to have no good reason to come to me,” Dellinger told reporters outside Washington’s federal courthouse after a recent hearing.
The Office of Special Counsel is also responsible for enforcing the Hatch Act, which restricts the partisan political activities of government workers. Dellinger’s firing came as Trump administration employees have touted their support on social media for his policies even though the Hatch Act is meant to restrict political advocacy while on duty.
The Justice Department employed sweeping language in urging the Supreme Court last month to allow the termination of the head of an obscure federal agency with limited power. Acting Solicitor General Sarah Harris wrote in court papers that the lower court had crossed “a constitutional red line” by blocking Dellinger’s firing and stopping Trump “from shaping the agenda of an executive-branch agency in the new administration’s critical first days.”
Dellinger was appointed by Democratic President Joe Biden and confirmed by the Senate to a five-year term in February 2024.
