Truro police mark 5th anniversary of Dylan Ehler’s disappearance
Truro police mark 5th anniversary of Dylan Ehler’s disappearance
Five years after he was last seen in his grandmother’s yard, the Truro Police Service is looking for information to help solve the disappearance of Dylan Ehler.
The three-year-old boy vanished in May 2020 while playing outside his grandmother’s house in Truro, N.S. After a six-day search, no trace of him was found other than his boots.
Firefighters found one of Dylan’s boots in the water of Lepper Brook, a stream close to the grandmother’s home. The other boot was found further down the brook at the mouth of the Salmon River.
In a post to social media on Tuesday, police shared photos of the boy along with age progression illustrations and images of the clothes he was wearing the day he went missing. Police said his disappearance remains an active investigation.

NSW government to introduce new laws to target ‘scourge’ of cybercrime fraud
NSW government to introduce new laws to target ‘scourge’ of cybercrime fraud
The NSW government is set to bring in sweeping changes to protect people at risk of identity fraud, after Australians lost more than $2bn to cyber-scams just last year.
The state government will introduce legislation on Wednesday to establish a new fraud check service that will allow government and other accredited agencies to confirm whether a person’s identity document (ID) details have been stolen or compromised.
It would be aimed at empowering agencies to stop criminals misusing people’s details to apply for grants or credit, and underpin efforts to help residents secure their ID info and avoid scams and thefts through the work of ID Support NSW.
Digital Government Minister ****** Dib said the legislation, known as the Identity Protection and Recovery Bill, would help protect residents in NSW against cybercriminals after more than 67,000 scams were reported to ScamWatch across Australia in 2024.
“These new laws will help safeguard NSW residents against cyber criminals and the scourge of identity theft, especially when it targets our most vulnerable citizens who can least afford it,” Mr Dib said.
Camera IconDigital Government Minister ****** Dib said the legislation will help protect residents in NSW against cybercriminals. NewsWire / Max Mason-Hubers Credit: News Corp Australia
“By alerting people quickly and supporting them to secure their identity and replace compromised ID documents, NSW residents will be better protected from impersonation, scams and fraud.
“The new Compromised Credential Register will enable these early notifications to both individuals and agencies, and will send up a red flag when someone tries to use an ID document that has been stolen or compromised.”
First launched in late 2021, ID Support NSW notifies residents when a data breach has occurred and helps them to replace any government documents.
It also provides community outreach and education about identity theft, privacy, and cyber security resilience.
Under the new bill, ID Support will operate as the “core government provider of identity protection and recovery services”, including setting up the Compromised Credential Register to provide a fraud check service for IDs, such as NSW driver’s licences and photo cards.
Once it is known an ID document has potentially been compromised – including a person’s personal details, driver’s license, and card number that may be on the dark web – it will be added to the register and the resident and issuing authority would then be notified.

Truck crossed center line in ****** with tour van that killed 7 near Yellowstone, police say
A pickup truck that collided with a tour van near Yellowstone National Park last week, killing seven people, crossed the highway’s center line and hit the van, according to Idaho State Police.
Investigating troopers have determined that the Dodge Ram pickup crossed the line on U.S. Highway 20 and struck the Mercedes passenger van, Police said in a Tuesday statement. Police are still investigating what caused the driver to veer into oncoming traffic.
There was a group of twelve ******** tourists and an Italian tourist on board the van, in addition to the driver. Five of the ******** tourists, the Italian tourist and the pickup driver died in the ******, according to police, the ******** Consulate General in San Francisco and the Italian Consulate General in San Francisco.
Police previously identified the pickup driver as Isaih Moreno, 25, of Humble, Texas.
The ****** happened Thursday evening near Henry’s Lake State Park in eastern Idaho. The state park is roughly 16 miles (26 kilometers) west of Yellowstone National Park.
The truck was traveling west while the van was traveling east toward Yellowstone when it happened. Video from the scene showed clear weather conditions at the time.
Both vehicles caught fire after colliding, police said. DNA tests results will be needed to identify the other people who died, according to police. The eight other people in the van were injured, police said.
Because a commercial vehicle was involved and because of the magnitude of the ******, the National Transportation Safety Board is also conducting an independent investigation, police said. NTSB personnel have visited the scene and are reviewing evidence, according to police.
According to the most recent data from the International Trade Administration, 36% of international visitors who arrived to the U.S. by air listed visits to national parks and national monuments as their top leisure activity while in the country.

Voting due to start to elect a new pope
Voting due to start to elect a new pope
Laura Gozzi
BBC News
Reporting fromVatican City******** MEDIA / HANDOUT
Voting desks for 133 cardinals have been set up inside the Sistine Chapel ahead of the conclave.
On Wednesday evening, under the domed ceiling of Michelangelo’s Sistine Chapel, 133 cardinals will vote to elect the Catholic Church’s 267th pope.
The day will begin at 10:00 (09:00 BST) with a mass in St Peter’s Basilica. The service, which will be televised, will be presided over by Giovanni Battista Re, the 91-year-old Cardinal Dean who was also the celebrant of Pope Francis’ ********.
In the early afternoon, mobile signal within the territory of the ******** will be deactivated to prevent anyone taking part in the conclave from contacting the outside world.
Around 16:15 (15:15 BST), the 133 cardinal electors will gather in the Pauline Chapel and form a procession to the Sistine Chapel.
All the while they will be singing a litany and the hymn Veni Creator – an invocation to the Holy Spirit, which is seen as the guiding hand that will help cardinals choose the new Pope.
Once in the Sistine Chapel, one hand resting on a copy of the Gospel, the cardinals will pronounce the prescribed oath of secrecy which precludes them from ever sharing details about how the new Pope was elected.
When the last of the electors has taken the oath, a meditation will be held. Then, the Master of Pontifical Liturgical Celebrations Diego Ravelli will announce “extra omnes” (“everybody out”).
He is one of three ecclesiastical staff allowed to stay in the Sistine Chapel despite not being a cardinal elector, even though they will have to leave the premises during the counting of the votes.
The moment “extra omnes” is pronounced marks the start of the cardinals’ isolation – and the start of the conclave.
The word, which comes from the Latin for “**** clave”, or “locked with key” is slightly misleading, as the cardinals are no longer locked inside; rather, on Tuesday ******** officials closed the entrances to the Apostolic Palace – which includes the Sistine Chapel- with lead seals which will remain until the end of the proceedings. Swiss guards will also flank all the entrances to the chapel.
Getty Images
Cardinals gathered during the ******** of Pope Francis at Saint Peter’s Square in ******** in April
Diego Ravelli will distribute ballot papers, and the cardinals will proceed to the first vote soon after.
While nothing forbids the Pope from being elected with the first vote, it has not happened in centuries. Still, that first ballot is very important, says Austen Ivereigh, a Catholic writer and commentator.
“The cardinals who have more than 20 votes will be taken into consideration. In the first ballot the votes will be very scattered and the electors know they have to concentrate on the ones that have numbers,” says Ivereigh.
He adds that every other ballot thereafter will indicate which of the cardinals have the momentum. “It’s almost like a political campaign… but it’s not really a competition; it’s an effort by the body to find consensus.”
If the vote doesn’t yield the two-third majority needed to elect the new pope, the cardinals go back to guesthouse Casa Santa Marta for dinner. It is then, on the sidelines of the voting process, that important conversations among the cardinals take place and consensus begins to coalesce around different names.
According to Italian media, the menu options consist of light dishes which are usually served to guests of the residence, and includes wine – but no spirits. The waiters and kitchen staff are also sworn to secrecy and cannot leave the grounds for the duration of the conclave.

Pope Francis died at the age of 88 on Easter Monday 2025
From Thursday morning, cardinals will be taking breakfast between 06:30 (05:30 BST) and 07:30 (06:30 BST) ahead of mass at 08:15 (07:15 BST). Two votes then take place in the morning, followed by lunch and rest. In his memoirs, Pope Francis said that was when he began to receive signals from the other cardinals that serious consensus was beginning to form around him; he was elected during the first afternoon vote. The last two conclaves have all concluded by the end of the second day.
There is no way of knowing at this stage whether this will be a long or a short conclave – but cardinals are aware that dragging the proceedings on could be interpreted as a sign of gaping disagreements.
As they discuss, pray and vote, outside the boarded-up windows of the Sistine Chapel thousands of faithful will be looking up to the chimney to the right of St Peter’s Basilica, waiting for the white plume of smoke to signal that the next pope has been elected.

Dan Ives Calls Palantir The ‘Missing Piece’ In AI Puzzle, Expects ‘Good News’ From Alex Karp’s Company On Monday
Benzinga and Yahoo Finance LLC may earn commission or revenue on some items through the links below.
Prominent Wall Street analyst Dan Ives has highlighted Palantir Technologies Inc. (NYSE:PLTR) as “the missing piece in the AI puzzle” just a day before the company’s highly anticipated earnings report on Monday.
What Happened: “Karp & Co. are a major barometer for the pace of U.S. commercial AI projects and initiatives and we expect good news from the Messi of AI on Monday,” the Wedbush Securities analyst wrote on social media platform X on Sunday, referring to Palantir CEO Alex Karp. Ives said Palantir remains “one of our top tech names to own.”
The endorsement comes as Palantir shares trade near all-time highs, surging 392% in the past year. During Friday’s session, the stock climbed 6.95% to $124.28 amid building investor enthusiasm.
Trending: If there was a new fund backed by Jeff Bezos offering a 7-9% target yield with monthly dividends would you invest in it?
Palantir has secured several high-profile defense contracts recently, including delivering two battlefield TITAN systems to the U.S. Army and announcing a new partnership with NATO Allied Command Operations to provide AI-powered military technology. The company’s Maven Smart System aims to enhance battlefield decision-making through advanced artificial intelligence.

Why It Matters: In the fourth quarter of 2024, Palantir posted $827.52 million in revenue and 14 cents in adjusted earnings per share, beating analyst estimates. U.S. revenue grew 52% year-over-year, and the company closed 129 deals worth over $1 million.
For the first quarter of 2025, analysts expect earnings of 13 cents per share on revenue of $862.83 million. The company has projected full-year 2025 revenue of up to $3.76 billion.
While Ives remains bullish, not all analysts share his optimism. RBC Capital maintains an Underperform rating with a $40 price target, highlighting the divided sentiment on Wall Street regarding Palantir’s valuation.

After U.S. President Donald Trump shattered — or at least fractured — global trade relationships and supply chains, there are promising signs of reconstruction in recent days. Indeed, U.S. Treasury Secretary Scott Bessent told CNBC on Monday the country is “very close to some deals.”
On Tuesday, newly elected ********* Prime Minister Mark Carney met Trump at the White House, potentially resetting a bilateral relationship that has been strained since January. And ******** Vice Premier He Lifeng is scheduled to meet Bessent in Switzerland this week for trade talks.
But enter the hurricane that is Trump, again. “We don’t have to sign deals, they have to sign deals with us. They want a piece of our market. We don’t want a piece of their market,” Trump said during his meeting with Carney, contradicting top White House officials’ claim for weeks that such deals are the administration’s top priority. Markets fell after his comments.
The growing protectionism of the U.S., ironically may help other countries forge closer economic ties with each other. The U.K. and India agreed on a bilateral trade agreement that will remove tariffs on most items within a decade. Meanwhile, ASEAN and China are set to meet on May 19 to negotiate improvements to a free-trade agreement, according to Malaysian Prime Minister Anwar Ibrahim on Monday.
They may be new bridges being built in the aftermath of Trump tariffs. But those connections could bypass the U.S. — which, according to Trump, does not need deals anyway.
What you need to know today
Officials from U.S. and China to meetU.S. Treasury Secretary Scott Bessent and trade representative Jamieson Greer will meet with their ******** counterparts in Switzerland this week to discuss economic and trade matters, their offices announced Tuesday. Later in the day, the ******** Foreign Ministry said that Vice Premier He Lifeng, Beijing’s top official for China-U.S. economic and trade matters, will meet with Bessent in Switzerland, NBC News reported.
The *** and India reach a trade agreementThe United Kingdom and India struck a bilateral trade agreement Tuesday, under which a majority of goods traded between India and the U.K. will become “fully tariff-free within a decade,” according to the British government. India will begin slashing tariffs on key U.K. exports such as whisky and automotives, while the U.K. will remove all tariffs on 99.1% of imports once the agreement comes into force, the Indian government said.
Markets fall on Trump’s trade commentsU.S. stocks fell Tuesday after Trump gave belligerent comments on trade deals. The S&P 500 declined 0.77%, the Dow Jones Industrial Average lost 0.95% and the Nasdaq Composite retreated 0.87%. Europe’s regional Stoxx 600 index dropped 0.18%, ending its 10-day winning streak. Shares of Deliveroo rose 1.9% after the British food delivery company said it had agreed to a takeover offer from American rival DoorDash that values the company at £2.9 billion ($3.9 billion).
AMD beats earnings estimates, warns of chip controlsAdvanced Micro Devices on Tuesday reported earnings for its first fiscal quarter that topped expectations and gave strong guidance for the current quarter. The forecast includes $800 billion in costs because of U.S. export limits on artificial intelligence chips. On a related note, Nvidia CEO Jensen Huang said Tuesday that China’s artificial intelligence market will likely reach about $50 billion in the next two to three years, and that missing out on it would be a “tremendous loss.”
India says it carried out strikes on PakistanIndia early Wednesday said its armed forces had conducted strikes against Pakistan and what it calls Pakistan-occupied Jammu and Kashmir, targeting “terrorist infrastructure.” The operation follows a militant attack in Pahalgam, Jammu and Kashmir, in which 26 people were killed last month and targeted nine sites, the statement said.
[PRO] U.S. “not a good place to hide”: JPMorganU.S. exceptionalism — in which the American economy and financial market have outperformed those of other countries since the pandemic — might be a thing of the past. This time, the U.S. “is not a good place to hide” if global economic growth slows down, wrote JPMorgan strategist Mislav Matejka in a note on Tuesday.

Trump trade tariffs slump widens to ‘nearly all U.S. exports,’ supply chain data shows
What began as a rapid drop in U.S. imports as shippers cut orders from manufacturing partners around the world has now extended into a nationwide export slump, with the U.S. agricultural sector and top farm products including soybeans, corn and beef taking the hardest hit.
The latest trade data shows that a slide in U.S. exports to the world, and China in particular, that began in January now extends to most U.S. ports. The Port of Portland, Oregon, tops the list with a 51% decrease in exports, while the Port of Tacoma, Washington, a large agricultural export port, has seen a 28% decrease.
The data is from trade tracker Vizion, which analyzed U.S. export container bookings for the five-week ******* before U.S. President Donald Trump’s tariffs began and the five weeks after the tariffs took effect.

Archaeologists Discovered 2,300-Year-Old Swords Featuring Infamous Symbols
Archaeologists Discovered 2,300-Year-Old Swords Featuring Infamous Symbols
Archaeologists discovered a Celtic necropolis from the second Iron Age filled with metal artifacts.
The team located two swords still in their sheaths covered in ornate decorations.
The swastika decorations found on one sword originate from Celtic tradition.
While it is most heavily associated in the Western world today with the horrific events of World War II, the swastika existed well before the Nazis co-opted the symbol to represent their monstrous regime. The design was—and continues to be—a common motif in a number of religions and cultures, and often represents good fortune or spirituality. And recently, archaeologists in France discovered two sheathed swords in a Celtic necropolis from about 2,300 years ago—one of which features small swastika decorations on the copper scabbard.
Archaeologists from the French National Institute of Preventive Archaeological Research (INRAP) said in a translated statement that the metal ornaments and weapons found in the skeleton-less tomb were of “exceptional manufacture” and have “little equivalent” in all of Europe.
Both swords were found among the artifacts in their sheaths, and one of them was dubbed “without a doubt, the most spectacular object of the necropolis.” The handle and the front plate of the sheath—designed to be worn at the waist—were made of copper and covered with eye-like decorations known as ocelli. Gemstones embellished the outside of the richly decorated sheath, and at least two of those decorations feature the swastika symbol.
The sword itself is a short, slender blade with an antennae handle made of iron. The team used X-rays to reveal inlays on the top of the blade, including what was once likely a sun and crescent moon separated by a line. Vincent Georges, an archaeologist with INRAP and manager of the excavation, told Live Science that the key cosmological symbols were collectively a “very widespread sacred concept linked to this particular kind of sword” during the beginning of the fourth century B.C. that was “fashionable among Celtic craftsmen.”
Due to the ornate decorations, Georges believes that the sword was mostly likely a non-functioning piece intended to show off status in a military setting. And while he can’t say it with certainty, he believes that the sword may have been made around the time of the Celtic incursions of northern Italy and the sacking of Rome in 383 B.C.
The second sword is longer and features rings allowing it to be carried at the waist. This sword has fewer decorations than the other, but still has embedded gemstones on the top of the sheath and eye-like ocelli designs. Remnants of fabric remain in the sheath, possibly from either the deceased’s clothing, a shroud, or a casing, according to the statement. The more functional design and finding of fabric means that it could have been used for its created purpose.
Experts believe both swords were created during the fourth century B.C. According to Georges, swastikas were common in the Mediterranean as ornamental motifs at the time, and Celtic culture adopted the symbol in mainland Europe. Experts believe the earliest Celtic use of the symbol was intended to evoke a sun moving across the sky and symbolized good luck.
The excavation in the small French town of Creuzier-le-Neuf—once a crossroads for major Celtic tribes—covered 7,000 square feet and featured over 100 graves from the Second Iron Age. The acidity of the soil didn’t allow for the conservation of the skeletons, and the site featured a single cremation with an accompanying vase.
Roughly half of the tombs included metal ornaments. Bracelets were the most common—many were simple rolled copper, but others featured decorations, rings, or clasps. The team found 18 brooches made of copper or iron, with the most impressive featuring a gemstone and silver leaf motif. Still, nothing was as notable as the fourth century B.C. sword ornately decorated with gemstones and swastikas.

Private Japanese lunar lander enters orbit around moon ahead of a June touchdown
Private Japanese lunar lander enters orbit around moon ahead of a June touchdown
A private lunar lander from Japan is now circling the moon, with just another month to go before it attempts a touchdown.
Tokyo-based ispace said Wednesday morning its Resilience lander entered lunar orbit.
“The countdown to lunar landing has now officially begun,” the company said in a statement.
SpaceX launched Resilience with U.S-based Firefly Aerospace’s lunar lander in January. Firefly got there first in March, becoming the first private outfit to successfully land a spacecraft on the moon without crashing or falling over. Another American company, Intuitive Machines, landed a spacecraft on the moon a few days later, but it ended up sideways in a crater.
Now it’s ispace’s turn. It’s targeting the first week of June for Resilience’s touchdown. The company’s first lander crashed into the moon in 2023.
The lander holds a mini rover equipped with a scoop to gather lunar dirt for analysis as well as other experiments.

Mortgage holders tipped to get much-needed relief: NAB boss
Mortgage holders tipped to get much-needed relief: NAB boss
National Australia Bank boss Andrew Irvine says a combination of a stable government and falling interest rates will help guide the *********** economy as he reiterates calls for the cash rate to drop to 2.6 per cent by early 2026.
In welcome news for homeowners, the NAB chief executive used his half-yearly results to talk up the strength of the *********** economy while also calling for further support for households.

“There’s no doubt these are challenging times, there’s all sorts of geopolitical uncertainties that we have to manage,” he said.
“That being said, Australia is in good shape. We enter this ******* of instability in a strong position.
“We have unemployment that’s very low, I believe we will see three or four base-rate reductions that will stimulate the domestic economy.”
Mr Irvine said global trade uncertainty from US President Donald Trump’s trade tariffs remained a key source of risk going forward for the *********** economy and reiterated calls for the cast rate to drop.
“The sound starting position of the *********** economy provides scope for a more stimulatory monetary policy response to support the recovery against potential headwinds, with the cash rate now forecast to decline from 4.1 per cent currently to 2.6 per cent by February 2026,” he said.

The Reserve Bank of Australia began its rate-cutting cycle in February, reducing the cash rate by 25 basis points from 4.35 per cent to 4.10 per cent. It held interest rates during its April meeting but is widely expected to cut on May 20.
NAB economist Sally Auld on Tuesday said the RBA would cut the cash rate by 50 basis points in May, followed by 25 basis point cuts in July, August, November and February.
The major bank is expecting five cuts in this rate-cutting cycle, with the central bank needing to “catch up” with recent global developments.
This would take the cash rate down to 2.6 per cent and shave an estimated $526 off monthly repayments for the average $600,000 loan.

NAB announced on Wednesday that its cash profit rose to $3.58bn for the six months to March 31, beating forecasts of cash earnings of $3.47bn and up 1 per cent on the prior corresponding *******.
But NAB said its net interest margin, a key metric of profitability, slipped 2 basis points from the March 2024 half to 1.7 per cent.
NAB’s interim dividend of 85 cents puts $2.6bn back in the hands of shareholders.
Mr Irvine said the *********** economy would also have the added benefit of a re-elected Labor government.
“If I look ahead, I think the recent election results are good for Australia. They bring stability, they bring consistency and they provide the Labor government with a clear mandate to drive the policies that we need in this country to support further economic growth,” he said.
NAB’s results follow rival big four bank Westpac, which announced a worse-than-expected result on Monday.
For the six months ending March 31, the bank’s net profit after tax fell 1 per cent to $3.3bn.

New VE Day law to stop Churchill statue sacrilege
New VE Day law to stop Churchill statue sacrilege
The government will make it a crime to climb on Winston Churchill’s statue in Parliament Square, it will be announced today.
Offenders could face up to three months in prison and a £1,000 fine for desecrating the monument to Britain’s wartime leader.
The Churchill statue is not officially classified as one of the ***’s war memorials, but Home Secretary Yvette Cooper plans to add it to the list of statues and monuments which it will soon become a criminal offence to climb.
These will include the Cenotaph in Whitehall, the Royal Artillery Memorial in Hyde Park, and many other famous structures across Britain commemorating the service of the armed forces in the First and Second World Wars.
The new law is contained in the flagship Crime and Policing Bill currently progressing through Parliament.
Announcing Churchill’s addition to the list of protected memorials, Cooper said: “As the country comes together to celebrate VE Day, it is only right that we ensure Winston Churchill’s statue is treated with the respect it deserves, along with the other sacred war memorials around our country.”
Churchill was said to have personally picked the spot where he wanted his statue to stand when approving plans for the redevelopment of Parliament Square in the 1950s.
The bronze, 12-foot statue of the former prime minister was unveiled in Westminster Square in November 1973 by his widow Clementine, eight years after her husband’s death.
Queen Elizabeth II and the Queen Mother were in attendance at the ceremony.
Giving his backing to the new protection, Prime Minister Sir Keir Starmer said: “Sir Winston Churchill stands at the summit of our country’s greatest heroes, and has been an inspiration to every prime minister that has followed him.
“The justifiable fury that is provoked when people use his statue as a platform for their protests speaks to the deep and enduring love that all decent British people have for Sir Winston.
“It is the least we owe him, and the rest of the greatest generation, to make those acts criminal.”
In recent years, the statue has become a regular target for demonstrators.
In 2014, a man was arrested after spending 48 hours on the statue plinth as part of Occupy Democracy protests in Westminster, but was subsequently acquitted of all charges.
The statue was infamously sprayed with red paint and adorned with a green turf Mohican during May Day protests in 2000, for which the perpetrator received a 30-day jail sentence.
The statue was also daubed with graffiti during Extinction Rebellion demonstrations in 2020, for which an 18-year-old protester was given a £200 fine and told to pay £1,200 in compensation.
During the ****** Lives Matter protests earlier that year, the statue was again sprayed with graffiti, and was eventually boarded up and ringed by police officers to protect it from demonstrators.
Most recently, trans rights campaigners who occupied Parliament Square in late April in protest at the Supreme Court decision on the legal definition of a woman, climbed the Churchill statue and waved placards from its plinth, as well as daubing slogans on other statues in the square.

Burger King Sued for Making Whoppers Look Too Big
Burger King Sued for Making Whoppers Look Too Big
Ever feel like the burger in the picture looks a little… more than what you actually get? Well, you’re not alone. Burger King is now facing a legal battle over claims that its mouthwatering Whopper advertisements pump up the patty and plump the produce to a degree reality can’t quite match. A judge has ruled that the fast-food giant must answer for these allegedly supersized illusions, setting the stage for a potentially juicy courtroom showdown.
Burger King hit with lawsuit alleging exaggerated Whopper sizes
Burger King is facing a class action lawsuit over allegations that its Whopper looks far more substantial in advertisements than in real life. The case, Coleman et al v. Burger King Corp., is being heard in the U.S. District Court for the Southern District of Florida (Case No. 22-20925).
On Monday, U.S. District Judge Roy Altman in Miami ruled that it is “plausible” some reasonable consumers could be misled by the fast-food chain’s promotional images. The suit, brought by 19 customers from 13 states, claims Burger King significantly exaggerated the size of its menu items in both in-store and online advertisements.
The plaintiffs argue that Burger King’s burgers are depicted as “overflowing” their buns, with the Whopper in particular appearing 35% larger and shown with more than twice the actual amount of meat.
While Burger King admitted its marketing team “styled sandwiches more beautifully” than restaurant staff, the company defended the practice, asserting that “reasonable consumers know the point of menu board photos is to make items appear as appetizing as possible.”
Judge Altman, however, found that the complaint describes advertising that “go[es] beyond mere exaggeration or puffery.” He noted the difference between this case and a similar lawsuit against McDonald’s and Wendy’s, which a federal judge in Brooklyn dismissed in September 2023. Altman pointed out that Burger King’s alleged exaggerations are more extreme, particularly in advertisements released after 2017, where the Whopper appears noticeably larger than in earlier campaigns.
Plaintiffs’ attorney Anthony Russo welcomed the decision, expressing satisfaction with the ruling. However, Burger King is outright denying the accusations.
“The plaintiffs’ claims are false,” Burger King said in a statement on Tuesday. “The flame-grilled beef patties portrayed in our advertising are the same patties used in the millions of burgers we serve to guests across the U.S.”
As of this writing, there is no publicly available information regarding the next hearing date in the class-action lawsuit against Burger King, which is owned by Toronto-based Restaurant Brands International, whose portfolio also includes Tim Hortons, Popeyes, and Firehouse Subs.
Subway faces a similar class action lawsuit over allegedly misleading ads
Subway also faces a class-action lawsuit filed in October 2024 in the U.S. District Court for the Eastern District of New York. The case, Tollison v. Subway Restaurants Inc et al (Case No. 24-07495), was initiated by Queens resident Anna Tollison. She alleges that Subway’s advertisements for its Steak & Cheese sandwich are “grossly misleading,” depicting sandwiches with at least 200% more meat than what is served to customers.
Tollison claims she paid $7.61 for a sandwich that contained significantly less meat than advertised. The lawsuit argues that such advertising practices are particularly concerning amid high inflation and food prices, disproportionately affecting lower-income consumers.
Subway has not publicly commented on the lawsuit. The company, now owned by Atlanta-based private equity firm Roark Capital, has faced similar legal challenges in the past, including lawsuits over the length of its “footlong” sandwiches and the sugar content of its bread.
