His artificial intelligence (AI) startup xAI is reportedly in the process of raising $20 billion in a new funding round, but his other attempt to conquer the fast-growing market seems to be facing new obstacles. For months, Musk has been locked in a legal battle with one of the industry’s hottest AI startups, maneuvering to stop a major transition it is planning. According to experts, he is facing a difficult road ahead. Musk has doubled down in his battle against OpenAI founder Sam Altman, someone with whom he once worked closely. Related: Elon Musk gets more bad news from a new rival An early investor in OpenAI, Musk also helped create and build the AI research organization, assisting in work that would lay the foundation for ChatGPT. However, he departed in 2018 over disagreements regarding its direction, sparking what would become a multi-year feud with Altman. Last year, it reached a boiling point when Musk filed a lawsuit against OpenAI and Altman. In it, he claimed the startup’s attempts to transition from a nonprofit entity to a for-profit structure constituted both fraud and breach of contract, prompting him to seek a preliminary injunction to stop it. In March 2024, U.S. District Judge Yvonne Gonzalez Rogers denied Musk’s attempt to block the transition on the grounds that he lacked the “high burden required for a preliminary injunction.” But now the case is moving forward quickly in the direction of a trial. It is currently scheduled for March 2026, though both parties may want to expedite the process. According to legal experts, Musk’s chances of winning his case against OpenAI don’t seem high. Arthur Dermendjian, a pre-litigation managing attorney at J&Y Law, spoke to TheStreet about the pending legal showdown between two tech-sector titans. Story Continues Dermendjian describes Musk’s claims as being relatively weak, leading him to believe the case won’t go well for him. “As a nonprofit, OpenAI did not issue shares or create shareholder contracts,” he states. “Unless Musk can produce a formal, written, and enforceable contract that explicitly prohibits OpenAI from creating a for-profit arm or limits its commercial activities, the case leans on informal understandings, mission statements, or general commitments, which U.S. courts are reluctant to enforce as binding contracts.” More Elon Musk News: He also notes that OpenAI is based in California, a state in which courts maintain high standards for “clarity and mutual assent in contract law.” Therefore, he sees Musk’s chances of winning a breach-of-contract case as being extremely slim, unless he can produce hard evidence of a contractual obligation on the startup’s part. While Musk is an undeniably polarizing figure, particularly since he began working closely with U.S. President Donald Trump, he seems to be focused on ensuring that OpenAI continues developing technology that is most beneficial to humanity as a whole. His arguments allege that this won’t be possible if the startup transitions to a for-profit structure. Twelve former OpenAI employees have come out in support of Musk’s lawsuit and asked to share their perspectives on the startup’s transformation. This could potentially complicate the case for OpenAI, depending on what the former staffers share. However, Dermendjian maintains that ultimately, while OpenAI has gone in a direction that did not align with Musk’s initial vision for the public-benefit AI research organization, it does not mean the company will be found guilty. “OpenAI’s later move to create a ‘capped-profit’ entity and sign a multi-billion-dollar deal with Microsoft diverges from that vision,” he states. “But whether those expectations were legally enforceable is another matter. The Kia driver then sped off down the highway, as seen on dashcam footage, and police kicked off a public search. The big story If people are spending in China, it’s likely to be on travel — and businesses want a slice of that. After 10 years as the only hostel in China’s Datong city, Fly by Knight suddenly gained six new competitors in one year, according to founder Daniel Huang. He said his 26-room venue was booked out for the May Labor Day holiday, which officially ran from Thursday to Monday. “Hotels are opening everywhere in Datong,” he said, noting that one no-brand operator raised its prices for the holiday by more than five times to over 1,000 yuan ($140) a night. Surging interest in history and culture is helping. The popularity of Datong’s Yungang Buddhist grottoes — a Unesco heritage site from around 1,500 years ago — skyrocketed after its statues were featured in the hit video game ****** Myth: Wukong released last summer. More than 43,700 people visited the caves on May 1 alone, up over 10% from a year earlier, according to state media. The Grand Canyon averaged 13,477 visitors a day last year. The latest holiday shows young ******** tourists remain very interested in museums and other cultural activities, said Ashley Dudarenok, founder of ChoZan, a China marketing consultancy. “What it means for international brands or local brands is that collaborating with those cultural icons is still a very, very important part of connecting with the consumer,” she said. Nationwide, China reported 314 million domestic tourist trips over the May Labor Day holiday, continuing the steady increase in recent years and well above the pre-Covid level of 195 million in 2019. The government has extended the holiday in recent years, giving locals more time off as businesses typically offer employees only a handful of paid vacation days. A short train ride China’s recently built transportation infrastructure is encouraging locals to visit smaller cities such as Datong, Huang said. He pointed out that before the Covid-19 pandemic, travelers had to take a six-hour train from the capital city of Beijing to Datong. Now, a high-speed train between the cities (about $20 per one-way ticket) takes less than two hours, with dozens of departure times throughout the day. The train route opened in December 2019. Tourists in China have been turning to less popular, more remote destinations that tend to be cheaper than visiting large cities. During the latest May Labor Day holidays, trips to rural areas rose by nearly 20% from a year ago, with interest in farm-themed stays surging, according booking site Trip.com. Retail sales, including food, rose by 6.3% during the holiday from a year ago, according to official figures. Tourism revenue increased by 8% to 180.27 billion yuan. “Despite concerns over macroeconomic headwinds, the strength of travel numbers tells us that consumer sentiment is resilient,” said Jacob Cooke, co-founder and CEO of WPIC Marketing + Technologies. The company helps foreign brands — such as Vitamix and IS Clinical — sell online in China and other parts of Asia. “******** consumers are prioritizing spending on what matters most to them — and right now, that includes travel,” he said. When ******** consumers were asked where they expected to increase their spending this year, travel topped the list, followed by groceries, according to a survey conducted on behalf of financial services firm TD Cowen in February and published last month. However, in a sign of lingering uncertainty, fewer respondents than last year said they had made travel plans for the next six months. The survey covered 2,000 ******** residents. Sales of retail goods have remained tepid since the Covid-19 pandemic, up by just 3.5% last year, according to official data. The services sector, including tourism, sports and childcare, has seen faster growth at 6.2% last year. China started reporting services retail sales on a year-to-date basis in July 2023. ‘Future of tourism’ ******** cities have meanwhile stepped up their efforts to attract tourists, whether through short videos on social media, virtual reality experiences or elaborate light shows splashed across skyscrapers. Some cities, such as the panda hub of Chengdu, are starting to use drones for delivering food within scenic parks, or renting out robotic-powered hiking support, Dudarenok pointed out. “We’re going to see basically a lot of what the future of tourism is going to look like, and China is testing that massively over this May day holiday,” she said, noting that places that have invested a lot are seeing robust tourist numbers. Chengdu, for instance, claimed a 6.2% year-on-year increase in tourist trips over the holiday to 15.52 million. That’s nearly three-fourths of the city’s population of 21.4 million, as of 2023. Social media influencers, as well as word-of-mouth comments about cleanliness and safety are also helping ******** cities attract foreign travelers, Huang said. Huang said his hostel primarily served international visitors prior to Covid, and the share of foreign guests has recovered modestly to about one-fifth of customers. Local visitors tend to concentrate their travel during public holidays, while trips by foreign tourists are more spaced out, he said. China has expanded its visa-free policies in the last two years to attract foreign tourists. Citizens of the U.S., U.K., Canada and more than 50 other countries can now stay in China for 10 days without a visa, while people from Japan, South Korea and several European countries can visit for up to 30 days. Inbound travel to China around the May Labor Day holidays rose by more than 40% from last year, according to Hostel World. In the markets ******** and Hong Kong stocks climbed Wednesday after the People’s Bank of China and financial regulators announced sweeping plans to cut key interest rates as they strive to shore up growth. China will cut the seven-day reverse repurchase rates by 10 basis points to 1.4% from 1.5%. The central bank will also lower the reserve requirement ratio by 50 basis points. Mainland China’s CSI 300 was up 0.44% while Hong Kong’s Hang Seng Index — which includes major ******** companies — rose 1.5% as of 10:30 a.m. local time. Truman has been lost in the Red Sea, a defense official confirmed to CBS News. The two pilots aboard the aircraft sustained minor injuries in the ordeal. The official said in a statement that the Super Hornet was attempting to land on the flight deck of the Truman Tuesday “when an arrestment failed, causing the aircraft to go overboard.” An arrestment is the mechanism that a carrier uses to safely slow down and halt a fighter jet as it lands. “Both aviators safely ejected and were rescued by a helicopter assigned to Helicopter Sea Combat Squadron (HSC) 11,” the official said. “The aviators were evaluated by medical personnel and assessed to have minor injuries. No flight deck personnel were injured.” On April 28, a Super Hornet was being towed in the Truman hangar bay when crews lost control of the aircraft and it went overboard, along with the tow tractor. One sailor suffered minor injuries in the incident. Two U.S. officials told CBS News that initial reports suggested the jet may have fallen overboard after the carrier turned sharply while taking evasive action against Yemen’s Houthi militants. Sean Parnell, a spokesperson for the Pentagon, said in statement that the Super Hornet that went into the Red Sea Tuesday “was not struck by the Houthis.” The Truman Carrier Strike Group has experienced several serious incidents since it deployed to the Middle East in September 2024. In December, the USS Gettysburg mistakenly shot down an F/A-18 which had taken off from the Truman. The two-person crew were able to safely eject. In February, the Truman accidentally collided with a merchant vessel near the Suez Canal. Also Tuesday, President Trump disclosed that the Iranian-backed Houthis had agreed to a deal that would see them halt their attacks on commercial and military vessels in the Red Sea. Six people were killed and 10 others were injured in the attack at Westfield Bondi Junction on April 13, 2024. Dawn Singleton, Yixuan Cheng, Faraz Ahmed Tahir, Ashlee Good, ***** Young and Pikria Darchia died in the incident. Cauchi, 40, had gone on a rampage through the palatial shopping centre with a WWII knife purchased at a camping store before being gunned down by NSW Police Inspector Amy Scott. A five-week coronial inquest into the deadly stabbing began last Monday, with the first week revealing never-before-heard details about the incident. He told the court a code ****** indicates a threat, while alpha is to escalate that. In the days after the attack he’d recalled hearing there was a man with a knife over the radio and a possible fatality, however he has since amended this statement upon reviewing CCTV of his actions on the day. “This recollection was taken three days after the incident had taken place …(it was) such a blur for myself,” Mr Gaerlan told the court. “I was highly emotional and highly stressed at the time and maybe my mind thought that happened.” If he had heard there was a man with a knife and a possible fatality, he said it would’ve been “almost certain it was an active armed offender (AAO) situation” and there would have been a “very different reaction”. The court was shown CCTV footage of Mr Gaerlan rushing out of the bathroom where he saw other staffing heading down to the centre. He went back to his desk to grab his blazer before going to the lifts and then walking towards the mall to see what was going on. CCTV played in court showed him walking through the mall where a number of customers gather around him asking what was happening, as retailers were also closing their shutters. The customers all appeared calm: no announcements had been made at that stage. While walking towards the level five air bridge he heard a security controller say “code ******, there’s an active armed offender, contact blue lights immediately, we need urgent backup” over the radio. He “turned on his heel” after hearing this and ran the other way, broadcasting to the control room asking to confirm police had been contacted and to make PA announcements for an AAO situation. The court was told he then returned to the centre management office to review CCTV, but upon realising it would take too long to find his logins, he again left the office to head to the CCTV control room. Customers were seen rushing into the lift Mr Gaerlan had taken. He was on the phone to the regional manager when he entered the control room about 3.40pm — about seven minutes after the attack began — and then had an exchange with one of the operators in the control room. “I still did not have eyes on the situation, I recall being frustrated,” he told the court, saying he had asked if they knew the location, how many offenders and what weapons were involved. “I was not provided with an answer at this time,” he said. Another controller was able to flick through footage and determine there was only one offender. “When the male confirmed … there was one offender, he showed me on the CCTV that a male in a green jersey was on the ground,” he said. However it was unclear whether information of there being a single offender was relayed to police at the time. No staff in CCTV control room when attack began The court was earlier told there were two staff members in the CCTV control room on level 4 on the afternoon of the attack, however, one had left about 3pm with his supervisor to undertake training on level 13. The other left the room at about 3.32pm to go to the bathroom just metres outside the control room, meaning there was “no active CCTV monitoring in place” for the minute and forty seconds she was outside the room. “It just so happened that exactly 40 seconds after …(she) left for the bathroom … Mr Cauchi attacked Ms Singleton,” counsel assisting the coroner Peggy Dwyer SC last week told the court. “And over the next 30 seconds, Cauchi attacked a further six individuals.” When she re-entered the control room at about 3.33pm Cauchi had attacked eight people by then, three of whom later died. The second security employee re-entered the CCTV control room by 3.36pm, however, all 16 people had been stabbed by then. Ms Dwyer said it appeared the CCTV room being vacant at that time impeded Scentre Group’s response. “Security staff were effectively behind the 8-ball – that is, they were then playing catch-up, catch up to understand what was unfolding,” Ms Dwyer said. Ms Dwyer said available evidence suggested initial contact and information exchanged between the control room and emergency services took place about 10 minutes after Cauchi was shot, and that an alert wasn’t activated until about 3.39pm. Credit: Supplied Later attempts to correct this were unsuccessful because of the evacuation alert in place, Ms Dwyer said. She said it also appeared appropriately warning customers and staff “did not occur promptly” on the day of the attack, and “did not occur in the way it should’ve done”. The first public announcement of an evacuation, rather than an AAO, was also not made until 3.52pm from the fire control room, which was located externally to the CCTV control room. Ms Dwyer said the control operator tasked with making the announcement was “distressed and distraught”, leading people to be unsure whether she had been taken hostage or was making the announcement “under duress”. The PA told bystanders to evacuate now, while shop attendants told bystanders they should not evacuate. Police also appeared to be under advice that people should remain in place. Ms Dwyer said the operator read “verbatim” from a script in a “distressed voice … in a way that may have led to confusion”. “Firstly Mr Cauchi had been shot about 15 minutes prior, so it’s not suggested that level of confusion at that stage … made a difference to who could’ve survived,” Ms Dwyer said. “Secondly, clearly these are individuals who’ve never been through something like this before, so its natural that stress … is overwhelming, or might be. “But it is important, in our respectful submission, to learn from the mistakes that have been made here.” Many customers and first responders reported the alarms set off were extremely loud and had impaired communications. Ms Dwyer said communications from the CCTV control room to both security staff and first responders might appear “ineffective”, but it was “in part exacerbated by issues” faced by NSW Police and NSW Ambulance first responders. She said if Inspector Scott had not been on the scene so quickly there was a “real possibility” Cauchi’s attack could have continued on. “I expect Your Honor will hear that there have been proactive steps already taken to remedy some of the issues outlined,” Ms Dwyer said. The spinning cylinder with circuitry is true to the original idea, showing that it can be plausible. Electrical waves spin off in random ways until they compound and create a runaway effect. There’s nothing some physicists love more than an outlandishly impossible sounding idea, from nuclear fusion power plants to Star Trek’s warp drive. (Fusion people, don’t come for us—we’ll happily share when a plant makes net energy over its operating costs, whenever that may be.) And recently, in a study uploaded to the preprint server arXiv, a team of scientists claimed to have made a very simplified “toy model” of something known as a ****** hole bomb. Could this particular decades-old idea be making a move toward real life? The answer is complicated. A ****** hole bomb is not a true ****** hole, obviously, but it is heavily inspired by the massive gravity wells. In 1971, Yakov Zeldovich iterated on Roger Penrose’s groundbreaking observations about ****** holes and wondered if the conditions seen in these structures could be harnessed as energy. Unlike a space superstructure, a ****** hole bomb might be a graspable human size. But scientists like Stephen Hawking predicted that, under some conditions, this energy would be too small to measure and verify the theories. Zeldovich, therefore, suggested adding a resonator in the form of a cylindrical mirror surrounding the original cylinder. Like an insulated coffee cup, the added metallic layer would reflect energy back into the ****** hole, and that energy would accumulate until it exploded outward and shattered the mirror. Others have iterated on these designs ever since. In this recent study, the research team attempted to take that ****** hole bomb concept from idea to reality—or, at least, take the first step towards reality by creating a toy model. A toy model is a very boiled down version of a theorized system, as the name suggests. Today, toy models explore things like quantum information theory or nanomaterials—in other recently published research, scientists used one to help model the strength of mismatched shapes and study how a particular arrangement of quantum qubits performs in computing. To create their toy model, the scientists nested a conductive aluminum cylinder—solid and just four centimeters in diameter—inside three concentric layers of circuitry. The setup was then rotated by an attached direct current motor (not that different from what powers an electric drill or rotating cake plate). As the assembly spun, the waves it produced grew more and more unstable until they achieved a runaway chain reaction effect. As the spinning cylinder generated positive energy radiating outward, the ****** hole effect created in its center absorbed all the negative energy, and the positive energy increased even more as the cylinder continued to rotate. But, instead of resulting in the predicted explosion, the team designed their assembly to switch itself off once it reached a certain point, ensuring that it did not explode (a good call, because it sure seems like it could have otherwise). “[T]he physical ingredients are as proposed more than 50 years ago,” the scientists explained. “The results show that extraction of rotational energy can be observed at low-frequencies, where the conditions for negative energies (or negative resistances) can be met. Furthermore, it also shows how this unstable regime can be switched on and off as predicted for the ****** hole bomb.” In other words, this setup realizes—almost exactly—what the “golden age” ****** hole pioneers of the 1960s and 1970s were theorizing. The rest of the way toward a true ****** hole bomb, the team concluded, is a matter of when, not if. In the meantime, these results must be evaluated and recreated by others. Starting Wednesday, the Transportation Security Administration will no longer accept state-issued identifications that are not REAL ID compliant. “If it’s not compliant, they may be diverted to a different line, have an extra step, but people will be allowed to fly,”Noem said at a U.S. House hearing on Tuesday. “This is a security issue.” Noem said earlier this week that 19 states issue driver licenses to immigrants who are not in the United States legally and enforcing the REAL ID will deny those individuals the ability to travel by air. In April, TSA had warned that air passengers could be denied access to flights without the enhanced IDs. Congress in 2005 approved new, stricter federal standards for issuing identification cards but enforcement has been pushed back repeatedly. TSA said in early April passengers 18 or older without passports or the enhanced ID “can expect to face delays, additional screening and the possibility of not being permitted into the security checkpoint.” TSA said last month 81% of travelers at checkpoints are currently presenting an acceptable identification. People also need those IDs to visit a federal building starting Wednesday. TSA in December 2022 pushed back the REAL ID enforcement deadline until May 2025. The 2005 law enacted the September 11, 2001, commission’s recommendation that the U.S. government “set standards for the issuance of sources of identification, such as driver’s licenses.” The law sets minimum security standards for license issuance and production. Many Americans travel by airplane just once or twice a year, and under former President Joe Biden last year, the TSA had said it was considering giving up to three warnings before travelers were told they could not travel on future flights without a new ID. Cici’s was purchased by new owners who cleared out all the company’s debt, and under the leadership of a president who has been with the brand for over 30 years, the chain refocused on its unique parlor experience and bringing back higher quality pizza. The one that will be most clear to customers is the expansion of game rooms, and remodeled Cici’s have expanded gaming areas from 400 square feet to up to 3,000 square feet, which has attracted a new wave of customers. A major technological overhaul installed new ordering systems and QR codes to push customer engagement. That focus on efficiency is important to Cici’s Pizza, which relies on affordability to attract customers, so keeping its costs down is essential. On the pizza side, the company has focused on bringing back older, higher-quality recipes that had been successful in the past. It has also added unique menu items like a Chicken & Eggo Waffles Pizza collab and a huge 28-inch party pizza with 64 slices. Sales grew by 31% in the first year after new ownership took over, and another 7.8% after that. Cici’s even reopened shuttered stores in North Carolina, Texas, and Alabama, and is courting franchise owners in places like Virginia and Atlanta. Ono, the current president of the University of Michigan and the only finalist to become the University of Florida’s 14th president, met with students and faculty on May 6 in a series of forums held at Emerson Alumni Hall in Gainesville. Ono discussed a range of topics during three separate one-hour sessions with faculty, students and staff, and administrators, including DEI, community outreach and experimental learning. Rahul Patel, chair of UF’s Presidential Search Committee and vice chair of the university’s board of trustees, said during Tuesday’s forum that Ono was one of 10 sitting university presidents considered for the role. Calling Ono a renowned researcher, Patel said part of the reason the committee unanimously selected him was his impressive resume and desire to create an open-door policy for faculty and students. “Everywhere Dr. Ono has been, he’s demonstrated a remarkable ability to connect and resonate with students, faculty, administrators, staff and stakeholders,” Patel said. Commending the work of previous UF presidents and faculty for instilling success, Ono said he’s been keeping track of the university’s academic and athletic achievements for the past 15 years. “What really drives me more than anything else is the students,” Ono said. “I can tell you that state support for the University of Florida is three times more than Michigan supported the University of Michigan and Ann Arbor and that’s pretty impressive, very attractive to a university president.” Ono answered varying pre-screened questions from stakeholders that were read by different members of the board of trustees. During the part of the day set aside for students, UF student body president and search committee member John Brinkman asked Ono for his thoughts on DEI initiatives, to which Ono replied that its ideology is changing higher education. Recalling his and former UF President Ben Sasse’s decision in recent years to close each university’s respective DEI office, Ono said he felt the investment was going toward the bureaucracy of the office, not the students. “Some of the things I hear is not everyone is included in the support that’s provided,” Ono said. “To me, it’s an American thing to support all students as opposed to just some of the students. It was my decision, but it was based on data and evidence, and this reallocation of funds allows more students to be given more opportunities.” Ono added that his position on eliminating the DEI office aligns with state government and the university. Ono said one of the ways he wants to excel as president is to engage more with the university and its network, a criticism UF faculty and students expressed of Sasse. Ono said he does not want to work all day in an administrative building and that he would implement more impromptu interactions with students and faculty. “I’m a faculty member myself and right now I’m in literature, sciences, and the arts, biology, school of medicine — which my discipline is ophthalmology — and visual sciences and other schools as well, and I still have a lab,” Ono said. Ono said he might even take the time to meet students at a nearby watering hole. “I’ve heard of a place not too far from here called midtown, specifically a bar called Salty Dog, but maybe I’ll see you for a drink if I’m selected,” he said. Boyd said he disagreed with Ono’s decision to close the Michigan DEI office, but felt he took a nuanced and respectful approach to the controversial topic. He also said he is happy that Ono is already engaged with the sports and academic communities. Nikolas Latorre, a junior economics major, said he was impressed with Ono’s straightforward answers and his initiative to create a future of experimental learning at UF, such as with artificial intelligence and agriculture. Ono, according to a May 4 UF press release announcing him as the only finalist for the position, holds a doctorate in experimental medicine from McGill University and has held previous faculty appointments at the Johns Hopkins University School of Medicine, Harvard University and University College London. He served as president of the University of Cincinnati from 2012 to 2016 and at the University of British Columbia in Canada from 2016 to 2022. If approved by UF’s board of trustees, Ono’s appointment must then be confirmed by Florida’s Board of Governors. He would be the permanent successor to Sasse, who resigned in July 2024 after just 17 months into the job, after his wife was diagnosed with epilepsy. Kent Fuchs, who served as UF president from 2015 to 2023, was quickly appointed by the board of trustees to serve as interim president, a position he has held since Aug. 1, 2024. “If I could select a dream candidate for the university’s next president, it would be Santa Ono,” Fuchs said in a UF news release.
