A comment on the place of worship’s Instagram page threatened to “Christchurch 2.0” the mosque at Edmondson Park in the city’s west, an apparent reference to the New Zealand city where an *********** man killed 51 worshippers in 2019. “Following a referral … to the Western Australia Police Force just before 5pm (Tuesday WA local time), a 16-year-old boy was arrested at Eaton, in southwest Western Australia,” according to a NSW Police statement issued late on Tuesday. “He is currently assisting police with inquiries.” Police say there are no ongoing threats to the community. Places of worship needed to be safeguarded from hatred and violence, *********** Islamic House president Mazhar Hadid said on Tuesday night. “We are profoundly concerned by this threat and take it with the utmost seriousness. “We also urge the public to remain vigilant and to stand united against Islamophobia and all forms of bigotry.” The mosque officially opened on Friday, the first day of Ramadan. Prime Minister Anthony Albanese said whoever was responsible for the abhorrent threat should face the full force of the law. “There is no place for this in Australia … racism and Islamophobia will not be tolerated,” he said in a statement. NSW Premier Chris Minns said the threat was the focus of a major police investigation. “Racist threats and Islamophobia will not be tolerated and will be met with the full force of the law,” he said in a statement. “This is very distressing, particularly as Muslims right across the state are participating in prayer during the month of Ramadan.” *********** Islamic House said nightly prayers would continue after it had been assured of an increased police presence. It took veterinarians at the San Diego Humane Society’s Ramona Wildlife Center 153 days to nurse a little fox to health. He was brought in with traumatic burn wounds on his paws caused by the Airport Fire, which burned 23,526 acres of land in September and October of 2024. The fox was slowly transitioned from around the clock medical care inside the clinic to an outdoor enclosure, before release. Clary | Afp | Getty Images A growth scare in the economy has accompanied worries over a resurgence in inflation, in turn potentially rekindling an ugly condition that the U.S. has not seen in 50 years. Fears over “stagflation” have come as President Donald Trump seems determined to slap tariffs on virtually anything that comes into the country at the same time that multiple indicators are pointing to a pullback in activity. That dual threat of higher prices and slower growth is causing angst among consumers, business leaders and policymakers, not to mention investors who have been dumping stocks and scooping up bonds lately. “Directionally, it is stagflation,” said Mark Zandi, chief economist at Moody’s Analytics. “It’s higher inflation and weaker economic growth that is the result of policy — tariff policy and immigration policy.” The phenomenon, not seen since the dark days of hyperinflation and sagging growth in the 1970s and early ’80s, has primarily manifested itself lately in “soft” data such as sentiment surveys and supply manager indexes. At least among consumers, long-run inflation expectations are at their highest level in almost 30 years while general sentiment is seeing multi-year lows. Consumer spending fell in January by its most in nearly four years, even though income rose sharply, according to a Commerce Department report Friday. On Monday, the Institute for Supply Manufacturing’s survey of purchase managers showed that factory activity barely expanded in February while new orders fell by the most in nearly five years and prices jumped by the highest monthly margin in more than a year. Following the ISM report, the Atlanta Federal Reserve’s GDPNow gauge of rolling economic data downgraded its projection for first quarter economic growth to an annualized decrease of 2.8%. If that holds up, it would be the first negative growth number since the first quarter of 2022 and the worst plunge since the Covid shutdown in early 2020. “Inflation expectations are up. People are nervous and uncertain about growth,” Zandi said. “Directionally, we’re moving toward stagflation, but we’re not going to get anywhere close to the stagflation we had in the ’70s and the ’80s because the Fed won’t allow it.” Indeed, markets are pricing in a greater chance the Fed will start cutting interest rates in June and could lop three-quarters of a percentage point off its key borrowing rate this year as a way to head off any economic slowdown. But Zandi thinks the Fed reaction might do just the opposite — raise rates to shut down inflation, in the vein of former Chair Paul Volcker, who aggressively hiked in the early ’80s and dragged the economy into recession. “If it looks like true stagflation with slow growth, they will sacrifice the economy,” he said. Sell-off in stocks The converging factors are causing waves on Wall Street, where stocks have been been in sell-off mode this month, erasing the gains that were made after Trump won election in November. Though the Dow Jones Industrial Average fell again Tuesday and is off about 4.5% through the early days of March, the selling hasn’t felt especially rushed and the CBOE Volatility Index, a gauge of market fear, was only around 23 Tuesday afternoon, not much above its long-term average. Markets were well off their session lows in afternoon trading. “This certainly isn’t the time to hit the panic button,” said Mark Hackett, chief market strategist at Nationwide. “At this point, I’m still in the camp that this is a healthy resetting of expectations.” However, it’s not just stocks that are showing signs of fear. Treasury yields have been tumbling in recent days after surging since September. The benchmark 10-year note yield has fallen to about 4.2%, off about half a percentage point from its January peak and below the 3-month note, a reliable recession indicator going back to World War II called an inverted yield curve. Hackett said he fears a “vicious circle” of activity created by the swooning sentiment indicators that could turn into a full-blown crisis. Economists and business executives see the tariffs hitting prices for food, vehicles, electricity and an assortment of other items. Stagflation “certainly is something to pay attention to now, more than it’s been in a while,” he said. “We have to watch. This is such a collapse in sentiment and such a change in the way people are viewing things and the level of emotion is so elevated right now that it will start impacting behavior.” White House sees ‘the greatest America’ For their part, White House officials are maintaining that short-term pain will be dwarfed by the long-term benefits tariffs will bring. Trump has touted the duties as way to create a stronger manufacturing base in the U.S., which is primarily a service-based economy. Commerce Secretary Howard Lutnick acknowledged in a CNBC interview Tuesday that there “may well be short-term price movements. But in the long term, it’s going to be completely different.” Market-based inflation expectations are in line with that sentiment. One metric, which measures the spread between nominal 5-year Treasury yields against inflation, is at its lowest level in nearly two years. “This is going to be the greatest America. We’ll have a balanced budget. Interest rates will come smashing down, and I mean 100 basis points, 150 basis points lower,” Lutnick added. “This president is going to deliver all of those things and drive manufacturing here.” Likewise, Treasury Secretary Scott Bessent told Fox News that “there’s going to be a transition *******” and said the administration’s focus is on Main Street more than Wall Street. “Wall Street’s done great. Wall Street can continue to do fine, but we have a focus on small business and the consumer,” he said. ” We are going to rebalance the economy, we are going to bring manufacturing jobs home.” Important clues on where the economy is headed should come from Friday’s nonfarm payrolls report. If the jobs count is good, it could reinforce the notion that the hard data has remained solid even as sentiment has shifted. But if the report shows that the labor market is softening while wages are holding higher, that could add to the stagflation chatter. “We have to be observant. The 8-gate analog stick was designed with fighting games in mind, so diagonal inputs should be easier to execute on the Octa Pro compared to a standard controller. Inside the box, you’ll find three hot-swappable D-pad designs. Hori also added a low-profile “analog slide pad” that resembles the Switch’s Circle Pad. The slide pad is meant to be used in menu systems. The controller is wireless, though it does include a USB-C cable for charging and wired play. It comes with a cable lock to mitigate the risk of a disconnection during a match. Hori says the the controller can run for roughly 10 hours between charges. In addition to the USB-C port, there’s a 3.5mm headphone jack. You’ll find a cable lock feature on the back of the gamepad–so you can lock the cable in place to ensure it doesn’t disconnect during the heat of battle. Expect to get around 10 hours of game time per charge. While the Octa Pro is technically compatible with PS4, it can only be used in wired mode on PlayStation’s last-gen console. The move put the stock on pace for its best day in more than a year. Okta posted adjusted earnings late Monday of 78 cents per share, while revenue increased 13% from a year earlier to $682 million. That beat the average analyst estimates of 73 cents per share of earnings and $669.6 million in revenue, according to LSEG. First-quarter revenue should come in between $678 million and $680 million, which also topped estimates. On the company’s earnings call, CEO Todd McKinnon called it a “blowout quarter” as bookings topped $1 billion in a single ******* for the first time. “We’re excited about the momentum we’ve built going into FY 2026 and are taking the right steps to advance our position as the leader in the identity market,” McKinnon said. “More and more customers are looking to consolidate their disparate and ineffective identity systems, and Okta is there to meet them with the most comprehensive identity security platform in the market today.” Okta allows companies to manage employee access or devices by providing tools such as single sign-on and multifactor authentication. Shares have rallied about 35% this year, including Tuesday’s pop, after slumping 13% in 2024. Some Wall Street firms turned more positive on the stock after the latest results, with both D.A. Davidson and Mizuho upgrading their ratings. D.A. Davidson called the likelihood of double-digit growth “durable” as the company shows signs of stabilization. Trump’s New Tariffs Could Strain Collection of Customs Fees Trump’s New Tariffs Could Strain Collection of Customs Fees The sweeping tariffs on *********, ******** and ******** products that President Trump imposed on Tuesday could strain the system that collects import duties and the government agencies that enforce those fees, trade and legal experts said. Collecting import duties is usually a routine task, but the new tariffs are being imposed on ******** and ********* goods, many of which have been imported into the United States duty-free for many years. Adding to the challenge is the sheer volume of goods subject to the new tariffs — U.S. imports from China, Mexico and Canada totaled over $1.3 trillion last year, or about two-fifths of all imports. The tariffs apply a 25 percent duty on goods from Mexico and Canada and an additional 10 percent on imports from China. Importers typically employ customs brokers to calculate and pay tariffs to the government agency that collects them, U.S. Customs and Border Protection. Adam Lewis, a co-founder and the president of Clearit, a customs broker, said that it would not be hard to tweak software to collect the new tariffs, but that a crucial part of the tariffs payment system might need significant adjustments. Importers must buy a “customs bond,” a type of insurance that guarantees the duties will be paid. Mr. Lewis said some customers might have to increase the size of their bonds to cover the extra tariff payments. “Many of their products were coming in duty-free, and all of a sudden there’s going to be a 25 percent increase,” he said. “It’s quite large.” In addition, policing importers for tariff evasion will now become a much ******* task for Customs and Border Protection and the Department of Justice. Some importers may try to avoid tariffs by understating the cost of goods in customs declarations or by falsely claiming they were imported from countries not subject to tariffs. “The greater the breadth and severity of these new tariffs, the greater the likelihood that at least some potential importers may want to misrepresent the value or the origin of their goods,” said Kirti Vaidya Reddy, a former federal prosecutor who is now a partner at the law firm Quarles. If the government finds that an importer has not paid duties, customs officials are likely to demand that the importer pay what is owed and a penalty that can double or even triple the amount due. In a statement, a customs agency spokeswoman said: “The dynamic nature of our mission, along with evolving threats and challenges, requires C.B.P. to remain flexible and adapt quickly while ensuring seamless operations and mission resilience. These tariffs will help maintain America’s global competitiveness and protect American industries from unfair trade practices.” Some evasion cases have become the subject of criminal prosecutions. Last year, a Miami importer pleaded guilty to participating in an import scheme involving ******** truck tires that the Justice Department said had cost the United States more than $1.9 million in forgone tariff revenue. This was true when ChatGPT started becoming popular, and it is even more accurate years later. The most recent example is the ******** AI startup DeepSeek. While most AI cloud providers like Google, AWS and Microsoft now offer the DeepSeek-R1 reasoning model, many AI experts believe that enterprises might be hesitant to use it due to the data it was trained on. Despite DeepSeek-R1’s innovation, it all comes down to the foundation, said Michelle Bonat, chief AI officer at AI Squared, an AI and data integration platform. “As GenAI expands and expands … the fundamentals are the fundamentals,” Bonat said on the latest episode of Informa TechTarget’s Targeting AI podcast. She added that while many organizations might have started with GenAI by just putting up a chatbot, many have found that if they do not have good-quality data, they might have to pause their GenAI initiatives. The reason is that the nature of generative AI systems is to produce responses. Therefore, if those systems do not have good-quality data, they tend to hallucinate. The reasoning behind this reversal is fairly obvious. The long-threatened Trump tariffs have officially gone into effect, which pops a 25 percent tariff on most ********* goods and a 10 percent tariff on energy exports. The contract was signed in November of last year and tasked Starlink with providing internet service to remote parts of Ontario. Ford, a former staunch supporter of President Trump, is prepared to go even further to protect Canada’s interests. He said that if the tariffs persist that the region will be forced to issue its own 25 percent surcharge on electricity exported to the US. He also said he would shut off electricity “with a smile” on his face to US customers if things aren’t resolved, according to the Toronto Sun. “We also need to be ready to dig in for a long fight,” Ford said. “We need to be ready to escalate using every tool in our tool kit.” It’s worth noting that Canada provides electricity to US residents in Michigan, New York and Minnesota, and a shutdown would impact over 1.5 million people. Ford has also floated the idea of issuing a surcharge to mineral exports or ending them entirely. Ontario’s primary liquor wholesaler, the LCBO, has confirmed that it will stop purchasing and selling US-made alcohol. Qdrant update adds security measures for AI development Qdrant update adds security measures for AI development Vector database specialist Qdrant’s latest update includes security, automation and real-time observability capabilities aimed at enabling enterprises to safely scale AI development, including generative AI. Vectors are numerical representations of data automatically assigned by algorithms that enable users to give structured to unstructured data such as text and images so that such data can be searched for and discovered. In addition, vectors enable similarity searches so that relevant data can be found to inform models and applications. Generative AI requires high volumes of relevant, high-quality data for accuracy. As a result, vectors have gained popularity in the two years since OpenAI’s launch of ChatGPT marked significant improvement in generative AI capabilities and spurred a wave of AI development. The latest Qdrant Cloud update, unveiled on Tuesday, features an API that simplifies managing cloud deployments, security features including managing hybrid cloud deployments that enable organizations to keep sensitive information on premises, and an integration with OpenMetrics to observe performance and usage in real time. With data security a significant concern for many organizations developing generative AI applications, Qdrant’s update addresses important enterprise needs, according to Donald Farmer, founder and principal of TreeHive Strategy. “Development teams are placing increasingly high demands on vector databases to enable more customized multimodal and agentic AI capabilities,” he said. “However, they are also very concerned with issues of privacy and data sovereignty, so … this Qdrant release, especially with hybrid cloud, plays well to those needs.” Based in Berlin, Qdrant is an open source database vendor whose platform enables users to store and search vectorized data. Vendors such as Pinecone and Redis are also vector database specialists. Meanwhile, more broad-based data management vendors, including tech giants AWS and Oracle, have made vector capabilities part of their database strategies. New capabilities With generative AI development requiring large amounts of data, it is imperative that data management tools, including vector databases, maintain performance speed as workload demands increase. As part of a push to provide enterprise-grade vector database capabilities, Qdrant in January added support for graphics processing unit-powered vector indexing given that graphics processing units (GPUs) deliver better performance and cost efficiency than central processing units (CPUs). In addition to performance, security is a major concern for many enterprises as they develop and deploy AI applications. Organizations need to combine their proprietary data with generative AI models such as ChatGPT and Google Gemini to develop generative AI applications that understand their operations. When data is combined with generative AI models, it is moved from storage in a database through pipelines that deliver it to the model for training. Public clouds can be more susceptible to data breaches than hybrid clouds and on-premises private clouds. Some organizations, therefore, prefer to develop their AI pipelines in hybrid or on-premises environments. After addressing performance concerns with its January update, Qdrant is now continuing its push to provide a more enterprise-grade platform by addressing security concerns, according to André Zayarni, Qdrant’s CEO and co-founder. “Qdrant’s focus has always been on high-performance vector search,” he said. “Now, with enterprises moving AI workloads into large-scale production, these applications must also meet stringent security, compliance and operational requirements.” Regarding the impetus for addressing security following performance improvements, user feedback was a main motivator, Zayarni continued. “Customer and community feedback … always is a core driver for our roadmap,” he said. “To be specific, the primary push for these features came from the need to scale AI applications from early production to large-scale enterprise deployment while ensuring security, efficiency and reliability.” Specific new Qdrant Cloud features include the following: Cloud API, a feature that simplifies managing cloud deployments by enabling administrators to manage clusters, authentications and configurations. Automated deployments and scaling the Cloud API and support for infrastructure-as-code workflows such as Terraform. Cloud role-based access controls (RBAC) that enable administrators to set fine-grained permissions for managing clusters, billing and hybrid deployments. An integration with OpenMetrics, a suite of observability tools built on the open source Prometheus monitoring framework, so users can track query performance and latency, request volumes, CPU usage and other metrics. While each aims to provide users with enterprise-grade capabilities, cloud RBAC is perhaps the most significant given that the number of people within organizations accessing and using vectorized data is rapidly increasing, according to Zayarni. “Data engineers, machine learning teams, IT security and even business users need controlled access to vector databases, without sacrificing security or agility,” he said. “Cloud RBAC [ensures] the right people have the right level of access.” Farmer, meanwhile, highlighted the Cloud API because it simplifies managing complex hybrid deployments. “As teams roll out their own hybrid solutions, it’s good for teams to be able to deploy infrastructure as code, especially when they are creating their own hybrid solutions because they need to be able to prototype, deploy and test numerous configurations to get it right,” he said. In addition, Qdrant’s recent addition of support for GPUs was significant, Farmer continued. There is currently a shortage of GPUs. Qdrant allows customers to use GPUs from any vendor, so provided customers can find available GPUs, they can be used to run Qdrant workloads. “I would normally say, ‘It gives users the freedom to choose,’ but right now it’s more the ability to work with whatever they are lucky enough to get their hands on.” Next steps Qdrant began in 2021 as an open source project. Qdrant Cloud, a commercial version of the vendor’s platform, was later launched in February 2023. His defamation action claims she “voluntarily admitted” being pressured into making false claims in what it describes as an “evil conspiracy” to extort money and damage his reputation. The anonymous woman filed her legal action in October and refiled it in December, accusing Jay-Z, real name Shawn Carter, and Sean “Diddy” Combs of raping her aged 13, after the 2000 MTV Video Music Awards. Both rappers denied the allegations. Jay-Z’s defamation action, filed at a federal court in Alabama, also accuses the woman’s lawyer, Tony Buzbee, and his co-counsel, David Fortney, of orchestrating her lawsuit. Mr Buzbee has garnered headlines internationally over the dozens of legal actions he has filed on behalf of people accusing Mr Combs of ******* misconduct, extortion, assault and other transgressions. Mr Combs has denied all the allegations. He is also facing federal sex-trafficking and racketeering charges, to which he has pleaded not guilty. The BBC understands that the US technology giant has appealed to the Investigatory Powers Tribunal, an independent court with the power to investigate claims against the Security Service. It is the latest development in an unprecedented row between one of the world’s biggest tech firms and the *** government over data privacy. In January, Apple was issued with a secret order by the Home Office to share encrypted data belonging to Apple users around the world with *** law enforcement in the event of a potential national security threat. Data protected by Apple’s standard level of encryption is still accessible by the company if a warrant is issued, but the firm cannot view or share data encrypted using its toughest privacy tool, Advanced Data Protection (ADP). ADP is an opt-in feature and it is not known how many people use it. Last week, Apple chose to remove ADP from the *** market rather than comply with the notice, which would involve creating a “*********” in the tool to create access. Apple said at the time that it would never compromise its security features and it was disappointed at having to take the action in the ***. The ***’s order also angered the US administration with President Donald Trump describing it to The Spectator as “something that you hear about with China”. Tulsi Gabbard, US head of intelligence, said she had not been informed in advance about the ***’s demand. She described it in a letter as an “egregious violation” of US citizens’ rights to privacy and that she intended to find out whether it breached the terms of a legal data agreement between the US and the ***. The FT, which first revealed Apple’s legal action, reports that the tribunal case could be heard in the next few weeks, but may not be made public. The Home Office refused to confirm or deny that the notice issued in January exists. Legally, this order cannot be made public. But a spokesperson said: “More broadly, the *** has a longstanding position of protecting our citizens from the very worst crimes, such as child sex abuse and terrorism, at the same time as protecting people’s privacy. “The *** has robust safeguards and independent oversight to protect privacy and privacy is only impacted on an exceptional basis, in relation to the most serious crimes and only when it is necessary and proportionate to do so.” Apple declined to comment. They have been on bail since they were arrested in London in September last year. The BBC podcast and TV documentary told the story of Lighthouse – which has since rebranded itself as Lighthouse Global – and how it began as a life coaching organisation led by a man called Paul Waugh. Three defensive plays with good-looking charts as markets shudder Three defensive plays with good-looking charts as markets shudder With the S & P 500 finally breaking below a key support level at 5,850, and the former high-flying “Magnificent 7” stocks trading more like the “Meager 7” in 2025, where can investors look to ride out this ******* of market uncertainty? We’ll highlight three stocks with three factors in common: they are in defensive sectors that tend to do well during bear market phases, they have a dividend yield higher than the S & P 500, and they are featuring compelling technical profiles. First, let’s look to the health care sector, which has actually been the top performing S & P 500 in 2025. While other stocks in the health care sector have experienced stronger gains so far in 2025, we’re focused on Bristol Myers Squibb Co. (BMY) because it’s currently working through a consolidation pattern. This sideways pattern started last October, soon after BMY broke above the $54 resistance level from earlier in 2024. With clear resistance around $61, a break above this price point would mean an upside resolution to this sideways trend, and BMY would then be sitting above two upward-sloping moving averages. With a dividend yield just over 4%, and a price trend close to a breakout point, we could see the powerful combination of strong price performance with a healthy dividend component for this emerging health care name. The second best performing sector in 2025 has been consumer staples, and the tobacco group has shown strong performance going back to mid-2024. While other tobacco names have experienced stronger price action, we see British American Tobacco (BTI) as a compelling option because of its recent downside gap to price support. BTI gapped higher in mid-January to achieve a new 52-week high, and traded just above $42 last month before a gap lower after their quarterly earnings call. The earnings miss pushed BTI down about 13% to its 50-day moving average, which once again held as key price support. This successful test of the 50-day came with an RSI value around 40, confirming that BTI remains in a bullish phase. Given the recent pullback, along with a dividend yield just above 7%, we see this as a compelling chart within a strong sector. Utilities became a growth trade in 2024, driven by the incredible power needs of artificial intelligence and other emerging technologies. Shares of American Electric Power Co. (AEP) have recently pushed to a new 52-week high while the S & P 500 and Nasdaq have dropped below key support levels, translating to a strong relative performance line at the bottom of the chart. The break above resistance at $102 last month suggested a new uptrend phase after a seven-month consolidation *******. AEP now sits above two upward-sloping moving averages, along with strong price momentum, improving relative strength, and a dividend yield around 3.4%. When the broad market indexes show clear signs of fatigue, and the previous leadership names begin to struggle, savvy investors look for stocks demonstrating strong relative strength and a decent dividend yield. Provided it gets the backing of member states, the law could end a tussle between car services groups, Big Tech and automakers that are all seeking to monetise in-vehicle data as they seek to develop new products and services. The data covers anything from driving habits to fuel consumption and tyre wear, and analysts have said it means the connected car market could be worth hundreds of billions of euros by the end of the decade. Ownership of the data is not clearly defined in EU law, which has resulted in the current dispute over access. “Due to many specificities of connected motor vehicles and its potential to open new business opportunities, including on ***-directional and smart charging, complementary measures are needed,” said the draft auto industry action plan seen by Reuters. “The Commission will therefore take adequate measures, including a legislative proposal on access to vehicle data, to allow the full automotive ecosystem to reap the benefits of data from connected vehicles,” it said, with the proposal planned for this year. Carmakers have cautioned against legislation that could impose blanket obligations on them and also warned of the risks to trade secrets as well as data misuse. The auto industry has in addition voiced concern that Big Tech could soon dominate the infotainment systems on cars’ dashboards. Alphabet’s Google and Apple have already got a foothold in the market. Nvidia valuation nearing 10-year lows, according to Bernstein Bernstein is taking a contrarian view on Nvidia stock even as other investors signal that valuations had grown for the broader artificial intelligence trade and as tariffs weigh on sentiment and depress prices. In fact, Bernstein managing director and senior analyst Stacy Rasgon argued that Nvidia’s valuation is a buying opportunity for investors, now that the stock is trading at roughly 25 times the next twelve months, or ****, estimated earnings. Rasgon says that’s the lowest forward valuation level in a year for Nvidia and close to a 10-year low. “Worries that the AI trade is ‘over’ feel a little premature to us, and valuation is getting increasingly attractive,” Rasgon said. “Sentiment has clearly pivoted for now on the AI group. However, spending intentions seemingly continue to rise, a product cycle is just kicking off, and we have GTC coming in a few weeks.” GTC refers to Nvidia’s GPU Technology Conference , an AI conference for researchers, developers, engineers and investors. By a 5-4 vote, the court’s conservative majority ruled that the Environmental Protection Agency overstepped its authority under the Clean Water Act with water pollution permits that contain vague requirements for maintaining water quality. The decision is the latest in which conservative justices have reined in pollution control efforts. Justice Samuel Alito wrote for the court that the EPA can set specific limits that tell cities and counties what can be discharged. But the agency lacks the authority “to include ‘end-result’ provisions,” Alito wrote, that make cities and counties responsible for maintaining the quality of the water, the Pacific Ocean in this case, into which wastewater is discharged. “When a permit contains such requirements, a permittee that punctiliously follows every specific requirement in its permit may nevertheless face crushing penalties if the quality of the water in its receiving waters falls below the applicable standards,” he wrote. One conservative justice, Amy Coney Barrett, joined the court’s three liberals in dissent. Limits on discharges sometimes still don’t insure water quality standards are met, Barrett wrote. “The concern that the technology-based effluent limitations may fall short is on display in this case,” Barrett wrote, adding that “discharges from components of San Francisco’s sewer system have allegedly led to serious breaches of the water quality standards, such as ‘discoloration, *****, and floating material, including toilet paper, in Mission Creek.'” The case produced an unusual alliance of the liberal northern California city, energy companies and business groups. The EPA has issued thousands of the permits, known as narrative permits, over several decades, former acting general counsel Kevin Minoli said. The narrative permits have operated almost as a backstop in case permits that quantify what can be discharged still result in unacceptable water quality, Minoli said. With the new restrictions imposed by the court, “the question is what comes in place of those limits,” Minoli said. Alito downplayed the impact of the decision, writing that the agency has “the tools needed” to insure water quality standards are met. In response to the decision, the Sierra Club, a grassroots environmental organization headquartered in Oakland, California, released a statement.
