The historic aircraft – which had two people onboard – veered out of the sky before crashing down among crops in West Hythe, Kent on Saturday evening (3 May). The ******-landing occurred in the lead-up to celebrations to mark the 80th anniversary of VE Day on Monday but it is not clear if the plane’s flight was connected to the event. Witnesses said the plane “misfired above a caravan park” and “narrowly” missed trees before it crashed, while video footage shows the plane heading towards the ground. What we know The plane is owned by Fly A Spitfire, confirmed the ****** in a statement on its website, saying: “We are aware of an incident involving one of our Spitfire aircraft. “We can confirm that a precautionary landing was made at a non-airfield site. The pilot and passenger are uninjured and at this stage we have no further information.” A spokesman for the fire service said two fire engines had attended after being called to an aircraft that had made an emergency landing. Crews helped to make the scene safe and one person was passed into the care of paramedics, the spokesman said. A video of the aftermath of the ****** shows the Second World War plane – which belongs to Spitfire experience company Fly a Spitfire – sitting in a mustard field after making its landing on Saturday evening. (SWNS) Eyewitness Sharon Gooda, 59, who was at the Daleacres Caravan and Motorhome Club when the drama unfolded, said: “We heard the roar of a Spitfire, so I stood outside the caravan and watched the two-seater as it flew across and turned back around again. “He took a fly over the caravan park but then I went back inside and could still hear them. But all of a sudden, there was a really low, loud misfiring sound above our heads.” She added: “It sounded like the engine had cut out totally. He was lucky he missed the big conifer trees as he wasn’t far off touching them. It could have been a lot worse. “He could have landed in the caravan park – he was really close to the caravans when he started misfiring and landed about 100m away.” The Air Accidents Investigation Branch (AAIB) said it had been notified about the incident, and while it has not sent a team to the accident site,will undertake an investigation with the operator to understand the cause of the loss of power. What we don’t know It is not know exactly what happened to lead to the emergency landing. While eyewitnesses have reported the sound of a plane misfiring, the company that owns it has only issued a statement confirming the “precautionary landing” and that the pilot and passenger are uninjured. It is also not know whether the flight being carried out by the Spitfire was connected to forthcoming VE Day celebrations or unrelated. Among efforts to mark VE Day, more than 20 planes will take part in a flypast over Buckingham Palace, including World War Two Lancaster bombers, the Red Arrows. Some reports have suggested the Spitfire involved in the landing was practising for a flypast, but this has not been confirmed. When large bipartisan majorities of Congress enacted and subsequently amended the nation’s major civil rights laws during both Democratic and Republican presidencies, policymakers were aware of two core truths about the salience of race and racism in the United States. They knew that that our society must eradicate rampant intentional racial discrimination in housing, employment, voting, and other areas. But they also knew that certain arbitrary, artificial, and unnecessary yet purportedly race-neutral policies would perpetuate the effects of that purposeful discrimination if left unchecked. Congress, through explicit statutory text, and the Supreme Court, in construing less explicit language, have turned to the “disparate impact” framework to address that second truth. When broken down in the simplest terms, how the disparate impact standard works and why it matters are easy to see. If a policy harms members of one group much more than others and if there is no good reason for the policy, it violates the law. In Griggs v. Duke Power Co., a unanimous Supreme Court, in part at the urging of President Richard Nixon’s Justice Department, first recognized the disparate impact framework in an opinion authored by the conservative Chief Justice Warren Burger. Duke Power, a utility company, had maintained a Jim Crow–style segregated workforce where ****** employees were only allowed to work at the lowest rung doing manual labor and were never hired to work in the four higher levels of the company hierarchy, which were all occupied by white employees. On the day Title VII of the Civil Rights Act became effective, banning racial and other forms of discrimination in employment, the company instituted new criteria for hiring and promotion, including a high school diploma, that were not tied to job performance. White employees who did not meet these criteria were exempted from the policy. Prohibiting practices like that is the sort of fundamentally fair, commonsense approach to rooting out systemic racism at which the Trump administration has taken aim through its Orwellian “Restoring Equality of Opportunity and Meritocracy” executive order, published last month. The executive order calls for the repeal of agencies’ disparate impact regulations under Title VI of the Civil Rights Act of 1964 and demands vague “appropriate action” (presumably dismissal) with respect to pending enforcement proceedings under other laws like the Fair Housing Act. The order proceeds from the baseless assumption that compliance with civil rights laws that allow for disparate impact claims is achieved by taking something away from members of another group. However, as Griggs illustrates, that is not how we remedy disparate impact violations of our civil rights laws. Instead, as Justice Anthony Kennedy put it his 2015 opinion in Texas Department of Housing & Community Affairs v. Inclusive Community Project that confirmed that disparate impact claims are available under the Fair Housing Act, orders “concentrate on the elimination of the offending practice.” The reform of zoning laws that prevent the development of affordable housing that is disproportionately needed by ****** families is an example of what it looks like in practice to eliminate the “offending practice,” and doing so does not take housing away from people who are not ******. There truly is no authority for the administration’s interpretation of the law. No majority opinion of the Supreme Court has cast doubt on the compatibility of the equal protection clause and statutes that allow for disparate impact claims. Justice Antonin Scalia speculated that there might be a conflict in his 2009 concurrence in Ricci v. DeStefano, an employment discrimination case, but he wrote only for himself and did not go so far as to conclude that there was a conflict. Later, in Texas Department of Housing & Community Affairs, dissenting opinions raised the specter of a conflict, but their views did not carry the day. This move to upend decades-old and previously noncontroversial civil rights protections on the strength of dissenting opinions is of a piece with the Trump administration’s broader attack on the rule of law and the functioning of government. For example, the administration has ousted independent agency officials who, by statute, can only be removed for cause while relying on a 1988 dissenting opinion from Scalia in a case that was decided 8–1. These officials include ones who play a key role in civil rights enforcement, such as members of the Equal Employment Opportunity Commission. In our system of laws, the courts are here to present a check on this pattern of lawlessness. Applying precedent and recognizing the tremendous extent to which communities nationwide have relied upon our patchwork of civil rights protections, it should not be hard for courts to reach the conclusion that both the executive order and the acts that we can expect the Trump administration to take to implement it are unlawful. It is the purview of Congress, not the White House, to determine the substantive scope of our civil rights laws, and we, as a society, are better off for having the check that the disparate impact standard provides against the discriminatory policies that are embedded in many of our institutions. Originally launched back in Spring 2012, the service allows visitors to pay €6 to hire a Nintendo 3DS handheld during their visit. While exploring the museum, the bespoke app on the 3DS shows visitors a map and uses geolocation tracking to help them navigate the museum’s numerous halls. It also provides information on each piece in the gallery in the form of more than 30 hours of audio commentaries, images and 3D models. Later this year the app, which was developed by Nintendo and spearheaded by Shigeru Miyamoto, will no longer be made available to visitors. “The New Nintendo 3DS console audio guides will go out of operation in September 2025, to be replaced by a new system,” a statement on the official Musée du Louvre website says (via Nintendo Everything). It’s not clear whether this new system will be another collaboration with Nintendo – perhaps using Switch Lite handhelds instead – or something different entirely. Neither the Louvre nor Nintendo has announced anything. In November 2013, Nintendo released a standalone version of the software on the 3DS eShop. The software, named Nintendo 3DS Guide: Louvre, allowed players to explore the gallery and its works from home if they weren’t able to visit the real thing in Paris. Nintendo was so proud of its association with the Louvre that it released a Nintendo Direct presentation focused solely on the software, with Miyamoto and Satoru Iwata exploring the museum itself. The newly-designated city is home to SpaceX and many of its employees, and it’s where Elon Musk’s company builds rocket engines, launches spacecraft and manufactures other space-related tech. According to the final vote tally, 212 residents voted in favor of incorporating as Starbase, while six voted against the measure — but, it’s worth noting that most of the eligible voters in the locale are SpaceX employees and only 143 votes were needed to make Starbase a city. on X, while the city also made its first post, stating that “becoming a city will help us continue building the best community possible for the men and women building the future of humanity’s place in space.” The idea for Starbase dates back to March 2021, when Musk the idea on what was then Twitter. Now that the vote has taken place, Starbase will be separated from Cameron County as its own roughly 1.5-square mile city. This designation is particularly important considering SpaceX may be able to circumvent governmental red tape when it comes to scheduling rocket launches. Previously, Musk’s company had to get permission from county authorities to close a nearby highway or restrict public access to Boca Chica Beach and Boca Chica State Park for rocket launches. While the vote to designate Starbase as an official Texas city passed, county commissioners and judges still need to declare the election results official, according to Remi Garza, the elections administrator for Cameron County. Those tariffs unveiled on April 2 were so severe that they raised fears Trump did not worry about causing a recession in his attempt to reshape the global economy. Within just four days, the S&P 500 fell about 12%, and the Dow Jones Industrial Average lost nearly 4,600 points, or about 11%. This past Friday, though, the S&P 500 rallied 1.5% for a ninth straight gain and pulled back to where it was on April 2. Of course, the index at the heart of many 401(k) accounts is still more than 7% below its all-time high set earlier this year. And stocks could easily fall again as uncertainty remains high about what Trump’s tariffs will ultimately do to the economy. But the run for U.S. stocks back upward has been just as wild and unexpected as its fall. Here’s a look at what happened: The pause On April 9, Trump announced on social media a “90-day PAUSE” for most of the tariffs he’d announced a week earlier, except those against China. The S&P 500 soared 9.5% for one of its best days ever. Even that good news came with a bit of controversy, however: hours before he announced the pause, Trump proclaimed on Truth Social that “this is a great time to buy.” De-escalation The weeks after the pause were a roller coaster. Trump talked about negotiating tariffs with the trading partners while also using tariffs to force companies to move manufacturing to the U.S., two goals seemingly at odds with one another. The market did find relief in what the Treasury secretary referred to as de-escalation between the U.S. and China. It would be used in part to host world leaders. “You know, when they have a party for, like, when the head of China comes in, or the head of anybody, you know, head of anything,” Trump said, “they have a party where they have a tent 200 yards away, where people have to walk in the rain to get to a tent. And that’s not for us. That’s not for the United States of America.” Trump noted that he built a ballroom at his Mar-a-Lago property and said his background as a real estate developer makes him uniquely equipped to carry out the White House renovation. But it’s not an inexpensive thing.
