John Gerard Benny Della Franca, 67, pleaded guilty in Stirling Gardens Magistrates Court on Thursday to ******** 40-year-old Tony Ditri on August 27, 2021. Mr Ditri was reported missing that same day and had last been seen at a tip bordering his property. His ******** were found ******* in a paddock the following month. Justice Joseph McGrath was told that there was a discussion between defence counsel Paul Yovich and prosecutor Brett Tooker about whether to hold a trial of issues over the issue of intention to cause ******. But they decided to go straight to sentencing, with Justice McGrath saying anything that may arise on that could be heard at Della Franca’s sentencing on September 13 or prior. Dates for his trial, starting August 26, were vacated.
