John Della Franca: South West farmer admits shotgun ******* of Pemberton father Tony Ditri

A South West farmer has admitted murdering a Pemberton father, backing out of plans to ****** the charge at a three-week trial starting later this month.

John Gerard Benny Della Franca, 67, pleaded guilty in Stirling Gardens Magistrates Court on Thursday to ******** 40-year-old Tony Ditri on August 27, 2021.

Mr Ditri was reported missing that same day and had last been seen at a tip bordering his property.

His ******** were found ******* in a paddock the following month.

Justice Joseph McGrath was told that there was a discussion between defence counsel Paul Yovich and prosecutor Brett Tooker about whether to hold a trial of issues over the issue of intention to cause ******.

But they decided to go straight to sentencing, with Justice McGrath saying anything that may arise on that could be heard at Della Franca’s sentencing on September 13 or prior.

The sentencing will be held at Busselton Courthouse, allowing family and friends to attend, the court was told.

Della Franca’s family travelled to Perth for Thursday’s hearing as he watched the proceedings via videolink from the maximum-security Casuarina Prison.

Dates for his trial, starting August 26, were vacated.

About 1000 community members turned out for Mr Ditri’s ********, where he was remembered as a family man and pillar of the Pemberton community.

He has also been charged with one count of possessing an unlicensed firearm and discharging a firearm to cause *****, with any penalty resulting from an admission to that bound to be folded into Della Franca’s jail term for *******.

In January last year, his son Andrew Della Franca admitted he illegally provided the 12-gauge shotgun used in the slaying, which was found during a police search of his father’s home two days after the victim was last seen alive.

The son pleaded guilty in Manjimup Magistrates Court to permitting possession of a firearm to person without a licence, saying he had “genuine remorse” about the incident and fully understood it was “the firearm used to ***** a man.”

Defence lawyer Tom Percy said his client never expected the ******* to be used that way.

Andrew Della Franca was fined $800 and granted a spent conviction.
