Shareholders are now suing the company in a class-action lawsuit alleging the chain was dismissive of the customer outrage. When Chipotle addressed and tried to rectify inconsistent portions, it cost them profitability and sunk share prices. Shareholders said in a complaint filed Monday that Chipotle “understated” diners’ dissatisfaction with “highly inconsistent (and in the view of some customers, lacking) portion sizes” in its risk disclosure in its 2023 annual report and 2024 first-quarter report. Customer grievances on social media escalated in the spring and summer months, according to the complaint, including one particular video from content creator Keith Lee, whose review of Chipotle—which included complaints of meager amounts of chicken in his burrito bowl—received 19.4 million views on TikTok. The complaint cited Fortune’s coverage of Chipotle customers’ discontent following a May interview with CEO Brian Niccol, who was named as a defendant in the suit alongside John Hartung, chief financial and administrative officer. Niccol told Fortune portion sizes had not gotten smaller and touted the company’s generous portion sizes saying, “it’s kind of who we are.” Niccol left the restaurant chain to become the chief executive of Starbucks in September, and interim CEO Scott Boatwright replaced him as the company’s permanent head, Chipotle announced the same day the lawsuit was filed. The complaint claimed Niccol’s statements were “materially false and misleading when made because portions had in fact gotten smaller in many cases.” Niccol’s comments followed an outpouring of concern on social media that Chipotle was skimping on meat and rice, which sparked the viral trend of diners filming Chipotle staff making their orders to pressure them to pile on toppings. A Wells Fargo analysis in June validated customer complaints, showing that among 75 burrito bowls, there was vast variability in portion sizes, particularly for online orders, with the heaviest burrito bowl weighing 87% more than the lightest bowl. “We don’t comment on litigation and will vigorously defend our industry leading real food,” chief corporate affairs officer Laurie Schalow told Fortune in an emailed statement. Niccol addressed customer concerns over portion sizes in a July 24 second-quarter earnings call, where he said more than 10% of Chipotle’s 3,500 locations had “outlier portion scores” and needed to retrain staff to make portions more consistent. Story Continues “There was never a directive to provide less to our customers,” Niccol said. “Generous portion is a core brand equity of Chipotle. It always has been, and it always will be.” Chipotle’s recommitment to unsparing bowl sizes came at a price to the company. The company reported lower-than-expected revenue in last month’s third-quarter earnings due to expensive ingredients, as well as rectifying inconsistent portion sizes. “The benefit of last year’s menu price increase was more than offset by inflation across several items, most notably avocados and dairy, as well as higher usage as we focused on ensuring consistent and generous portions,” chief financial officer Adam Rymer said in the earnings call. Though foot traffic and same-store sales increased over the quarter, investors were less than impressed, and Chipotle’s stock fell nearly 8% following the earnings report. Ultimately, because Chipotle only later acknowledged the problem with its portions—and fixing the inconsistencies came at meaningful expense to the company and its shareholders—the chain’s true ******** was the speed at which it disclosed its awareness of and addressed the problem, the lawsuit claims. “As a result of Defendants’ wrongful acts and omissions, and the precipitous decline in the market value of the Company’s common shares,” the complaint said. “Plaintiff and other Class members have suffered significant losses and damages.” The class-action lawsuit is seeking damages for those who bought or traded Chipotle stock or options between Feb. 8, 2024 and Oct. 29, 2024. Sindy Sidhu from Warrington said she now felt too intimated to try other spas after her negative experience. She has instead been getting help from the Made For Life Foundation, a charity fighting for spas and salons to end policies banning staff from treating ******* patients. Carden Park Spa in Cheshire has backed the campaign, and director Emma Pridding, admitted the industry “had been a little guarded” in treating those with ******* due to insurance concerns and false fears it could cause harm. The charity says some spas are “misinformed” about how to treat ******* patients Made For Life Foundation founder Amanda Winwood said a large proportion of the women who attend her events have been turned away from some spas, salons, or independent therapists. She told BBC Radio Manchester that there was a huge lack of awareness about how to look after people with ******* in the spa community. She said that this started at college level as some spa therapists were trained that it was harmful to massage ******* patients. Ms Winwood added that another factor that contributed to this issue was insurance companies. She said: “Often insurance companies will refuse to insure spas to welcome people with *******, which is an absolute travesty as far as I’m concerned, and contravenes the Equality Act 2010.” Under the Equality Act, ******* is classed as a disability and therefore all anti-discrimination laws apply to people with ******* or those who have had ******* in the past. In the past it was thought that having a massage when you have ******* may make the ******* cells travel to other parts of the body. However, ******* Research *** have since stated that no research has proved this to be true. A spokesperson for complimentary therapies at The Christie ******* Hospital said “historically there had been some misunderstandings about the safety of offering massage to patients with *******”. The caution was “understandable when spas were first open” but research has shown massage for patients can be “highly beneficial to their physical, psychological, and emotional health and wellbeing”, they added. “However, deep tissue massage is best avoided, and it’s crucial to provide the therapist with your full medical history so they can identify any contraindications and adjust your treatment accordingly.” Ms Sidhu now attends Tea and Therapy events run by the Made for Life Foundation Ms Sidhu, 60, was diagnosed with ovarian ******* in 2021, and said that “touch is something that you do need”. She added that after ticking that she had ******* on a form, a spa informed her that she could not have any of the treatments. Ms Sidhu continued: “Now I don’t ask the question. “It’s ironic because I have a therapist at the hospice that gives me massages but when it comes to spas, I don’t ask because I felt quite intimidated, and I don’t want to feel like that again.” Ms Sidhu instead started attending Tea and Therapy events, a wellbeing event for people with *******, where they can socialise, receive guidance, and get massages. ‘Have difficult conversations’ Tea and Therapy is run across the *** by Amanda Winwood, founder of the Made for Life Foundation and Jamie Edwards, a performance coach from Manchester. The campaign, BRF, uses Bethany’s initials as an acronym but also stands for Believe, React Fast, which is the message Ms Jones wants to take to the police and others with responsibility for looking after domestic ****** victims. On Oct. 30, Fannin County deputies were called to the area of Mineral Bluff Highway and Georgia 60 regarding a child in the road. According to authorities, when the witness asked the boy if he was OK, he said “yes.” She asked if he needed help, he said “no.” She asked where his parents were and what his mother’s name was and he told her she worked at the post office and her name was Brittany Patterson,41. She asked if he needed help again and he said “never mind” and he then ran behind a ***** station. Deputies said they searched the area for the child and found him on Railroad Avenue, a little over a mile from his home. According to the report, deputies said the child seemed to be confused as to what was going and when asked where he lived, he pointed in the direction of Hwy. 60. Deputies asked for his mother’s name and number but were only able to give her number. Fannin County officials spoke with Patterson over the phone. When they told her that her son was out on Railroad Avenue, deputies said “Patterson seemed very unsurprised or concerned with this information.” TRENDING STORIES: The report states that Patterson told deputies she was in Ellijay with one of her other children for an appointment. She told deputies that her son was supposed to go with her to the appointment and she waited in the car for him for five minutes and he never came to get in the car. Patterson told deputies she went in the house and he wasn’t in the house and “couldn’t find him anywhere,” so she left because she did not know if he was in the woods or where he was and she was running late for her other child’s appointment. In the report, Patterson said, her son is “very defiant” and “doesn’t listen to her” and said she was at her “wit’s end” with dealing with him. When deputies asked Patterson why she didn’t call the sheriff’s office to let them know her child was missing, she responded that “she didn’t know to do that if she just wasn’t sure where he was.” Deputies said an hour had passed since her son had been missing. Deputies later arrived at Patterson’s home. She was arrested and charged with reckless conduct. The Division of Family and Children Services was also contacted. Hackers linked to a ******** intelligence agency were able to breach T-Mobile as part of a months-long campaign to spy on the cellphone communications of high-value intelligence targets, the Journal added, without saying when the ******* took place. “T-Mobile is closely monitoring this industry-wide *******,” a company spokesperson told Reuters in an email. “At this time, T-Mobile systems and data have not been impacted in any significant way, and we have no evidence of impacts to customer information.” It was unclear what information, if any, was taken about T-Mobile customers’ calls and communications records, according to the WSJ report. On Wednesday, The Federal Bureau of Investigation (FBI) and the U.S. cyber watchdog agency CISA said China-linked hackers have intercepted surveillance data intended for ********* law enforcement agencies after breaking into an unspecified number of telecom companies.
