More come forward When Araceli Lopez noticed her father, Arturo, would come home from work without his paycheck, she started to worry. The 39-year-old and her mother imagined the worst. Was he living a double life? Was he secretly spending his money somewhere? She decided to follow him to work one day to see what was going on. When she finally confronted him, he told her he was getting paid half in cash and half in checks that bounced. “My dad never lied to us. He was always saying the truth,” Lopez said. Arturo Lopez is one of several former employees of Martinez Pallet Services who have accused the company and its owner, Jose De Jesus Mora-Martinez, of years-long wage theft. Lopez alone said he is owed $109,646 in unpaid wages and penalties in the four years he worked at the company. Since August, more former employees have come forward, filing formal wage theft claims with the Labor Commissioner’s Office. In total, nine employees are seeking $628,695 in unpaid wages from Martinez Pallet Services. The company has since filed for Chapter 11 bankruptcy and submitted a reorganization plan, laying out how it intends to continue operating while paying off its debts. Under the plan, Martinez Pallet Services will remain in business and repay creditors—including former employees claiming wage theft—over the next five years, relying on its operational profits to meet those obligations and avoid liquidation. The workers, through the help of the North Valley Labor Federation, have rejected the plan, claiming it is unfeasible and fails to account for the company’s “significant civil liabilities resulting from its ongoing and willful pattern of labor law violations.” At a U.S. Bankruptcy Court hearing Feb. 20, the former employees urged Judge Ronald H. Sargis to clarify the timeline of their case and asked for assistance. Some shared how they’ve struggled to find work since leaving the company. Because the former employees rejected the initial reorganization plan, a revised plan is not expected until June or July. An attorney representing Martinez Pallet Services said that, due to the active bankruptcy filing, the company is reserving comment at this time. “We’re keeping the people on track. But again, nothing in the court system moves rapidly,” Sargis told the group. He also suggested the former employees consider finding an attorney and splitting the cost among themselves. Will Kelly, executive director of the Northern Valley Labor Federation, said they are working to secure legal representation, but finding an attorney has been challenging. Few lawyers specialize in cases like this, and those who do can be costly. The workers are hoping to find an attorney willing to take the case pro bono. “I know it’s taking so long, and I hope everyone’s really proud of what you all have accomplished, like sticking with this, working as a team. If it wasn’t for what you all have done, they would have just skated through this,” Kelly told the group in the NVLF office after the Feb. 20 hearing. “They’d have their plan confirmed. They’d be onto the next thing, they’d be stealing from more people.” Caitlin Vega, general counsel for the California Federation of Labor Unions, submitted a letter in January expressing support for the workers and accusing Jose Martinez of committing widespread violations of state labor law, including the misclassification of workers as independent contractors. “In addition to penalties available for unpaid wages, Labor Code Section 226.8 also provides penalties of up to $25,000 per violation for employers engaging in a pattern and practice of willful misclassification,” reads the letter. Vega’s letter was included in the objection exhibits filed with the court. More employees continue to file claims, including some as recently as February. One such employee, Felipe Barcenas Zuniga, alleges he was fired in retaliation for requesting his overdue paycheck. He also claims he was never informed that he was classified as an independent contractor, as he does not operate an independent pallet-making business. Another employee, Ismael Peres, claimed Martinez offered him a notarized letter promising to pay off his claim in $1,000 weekly installments if he withdrew his claim from bankruptcy. Martinez never provided him with a copy of the letter or made any payments, Peres stated. Kelly said some of the workers, for immigration reasons, have trouble finding other jobs. He said he believes Martinez knows that and preys upon it. Lopez noted that many of those Martinez has exploited are older individuals who never refused to work overtime, even in harsh weather conditions with some of the work being done outside. Worker experiences Lopez said her father used to spoil her mother, but that’s no longer the case. As much as she tries to support her parents, she also has two daughters of her own to care for. Martinez “put my family in a bad situation, and I hate him for this. I really do hate him. Like, how can he harm somebody like that? How can he harm so many families?” she said. Sergio Larios began working at Martinez Pallet in February 2020. By March 2023, he started noticing that his pay became inconsistent. He said he would confront Martinez, but each time he was given an excuse. As a result, Larios maxed out two credit cards and drained his savings to cover his living expenses. Fortunately, he was eventually able to find a new job and regain control of his finances. However, the experience has made it difficult for him to trust future employers. Many of his former coworkers are still struggling to find work, he said. “Something else that’s really important that I want to see come out of this is that he doesn’t do this to anyone else. That would be very important for this case,” Larios said in Spanish, through an interpreter. Felicitas Molinas said she has been unable to find another job since leaving and is on the brink of losing her home. In the meantime, her children have been helping support her as she continues to search for work. She noted that applying for jobs online has been a challenge for her. “I’m used to paper applications, and I would go in and ask for one, fill it out and wait for a call. But it’s not like that anymore, and that’s difficult for me,” Molina said through an interpreter. She said she had been hearing about people not getting paid for some time, with checks bouncing regularly. From this experience, she’s learned the importance of coming together, finding support and staying united. She remains hopeful that former employees eventually will get the money they are owed. Pedro Davalos said there were times when he would receive consistent pay, followed by stretches with no payments at all. After leaving, he found work driving trucks for a tomato company, but only seasonally. Diana Diaz, lead organizer of NVLF, asked if his perspective had changed now that he had learned more about his rights as a worker. “Yeah, I won’t be working with Jose Martinez anymore,” Davalos said, through an interpreter. The Stanislaus County District Attorney’s Office told The Bee on Friday that the matter has since been referred to its Bureau of Investigations. The email shown to CBS News instructed federal workers to “please reply to this email with approx. 5 bullets describing what you accomplished last week and cc your manager.” It also indicated that such an edict would continue. “Going forward, please complete the above task each week by Mondays at 11:59pmET,” the email read. The Department of Homeland Security, the Department of Energy and the Treasury Department were among the agencies that received it. However, unlike the first such email circulated to the federal workforce last week, it allowed employees who deal with sensitive information to opt out of a full response. “Please do not send links, attachments, or any classified/sensitive information,” the email read. “If all of your activities are classified or sensitive, please write ‘All of my activities are sensitive.'” Earlier Friday, sources familiar with the directive confirmed to CBS News the new email was expected to come from individual federal agencies, not the Office of Personnel Management, as was the case with the emails sent last week. That government-wide directive caused confusion as to whether a response was required — and the possible ramifications of not answering. With this new round of emails, OPM advised agencies to send the messages themselves, and each department has the discretion to decide whether to do so, sources told CBS News earlier Friday. The emails are part of a strategy to have agencies account for their employees’ work each week and report it back to the government’s human resources agency, though no decision has been made about whether the messages will go out weekly, the sources said. In addition to the individual agencies deciding whether to send the emails, each will decide how long their workforces have to respond and the consequences of not replying, CBS News learned. Since returning to the White House, President Trump has made reducing the size of the federal government a key part of his second-term agenda. He tasked Elon Musk to lead the cost-cutting effort through the White House’s Department of Government Efficiency, though the billionaire is not the administrator of the task force. The White House confirmed earlier this week that Amy Gleason, who worked at the U.S. Digital Service, the precursor to DOGE, is its acting administrator. But Musk and his team have roiled the federal government with their initiative; as thousands of probationary federal workers were fired, DOGE employees have sought access to departments’ data systems housing sensitive information and work at some independent agencies has ground to a halt. Their actions have sparked numerous lawsuits, and on Thursday, a federal judge in California found that the mass firings of probationary employees were likely unlawful. The initial round of emails sent to the federal workforce last Saturday came from OPM with the subject line “What did you do last week?” It directed recipients to reply with five examples of what they accomplished in the prior week and include their bosses in the response. Government employees had until 11:59 p.m. Monday to answer and were told not to “send any classified information, links, or attachments.” Musk had initially warned on social media that a failure to respond “will be taken as a resignation,” but several agencies, including the FBI and Departments of State, Homeland Security and Defense, told their employees to ignore the request. OPM then told human resources officials from departments Monday that it was up to each agency to decide how they would handle the emails to their workers. But a memo also sent Monday to agency leaders that sought to provide guidance on the government-wide “what did you do last week” email said responses should be directed to department leadership, with a copy going to OPM. It said “agencies should review responses and evaluate nonresponses.” The memo did not mention the directions given by department heads that instructed their workforce not to reply. Roughly 1 million federal workers responded to the first “what did you do last week” email. Mr. Trump said during a Cabinet meeting Wednesday that those who didn’t reply “are on the bubble” and said his administration wasn’t “thrilled” about the non-responses. “Maybe they’re going to be gone, maybe they’re not around, maybe they have other jobs,” the president said. Schools across the country had a deadline of March 1 to choose whether or not to opt into the agreement, made in May 2024, which Judge Claudia Wilken of the United States District Court for Northern District of California granted preliminary approval of on Oct. 7, 2024. A final approval hearing is scheduled for April 7, 2025, and it’s widely expected Wilken will officially approve the settlement. Burdge was approached for comment on whether or not NM State would opt into the settlement on Friday morning, and a university athletics spokesman provided this statement via email on her behalf on Friday evening: “NM State is proud to opt in to the terms of the House v. NCAA settlement, as this is the right decision for our institution and, most importantly, our student-athletes,” Burdge said in her statement to the Sun-News. “Their hard work, dedication, and contributions to our university deserve to be recognized and supported in meaningful ways. “This decision strengthens our commitment to providing the best possible experience for our student-athletes on and off the field by ensuring they have the resources and opportunities they need to thrive. The House vs. NCAA settlement outlines name, image and likeness payment methods for current and former student-athletes. For former student-athletes, it amounts to damages totaling $2.78 billion over the next 10 years at approximately $277 million annually. Group of Five schools like NM State are responsible for approximately 10% of the NCAA’s total damages. The settlement is a culmination of an ongoing legal battle since 2020, when then-collegiate athletes Grant House and Sedona Prince sued the NCAA and the then-Power Five Conferences — the ACC, Big 12, Big Ten, Pac-12 and SEC — for NIL damages and an injunction to force the NCAA to remove restrictions on revenue-sharing from broadcast television rights. In addition to the $2.78 billion in back payments over 10 years, all parties agreed to the creation of a revenue-sharing model for power conferences. Power conference schools were required to opt-in, while other schools and conferences — like NM State and Conference USA — were given the option to join the new structure. For current student-athletes, the settlement mandates NIL deals not established through the university and valued at $600 or more must be reported to a third-party clearinghouse to ensure compliance with market value standards. The settlement also implements roster caps for sports, such as 105 players for football and 15 for basketball. The settlement’s terms, if approved, will come into effect at the start of the 2025-26 academic year on July 1. How does this affect New Mexico State? Burdge told the Sun-News that NM State is still working out the exact details of how the university will distribute revenue to its student-athletes. Schools are allowed to pay a maximum of $20.5 million to student-athletes, mirroring an estimated share of 22% of annual revenue generated by Power Four schools. A model outlined in the House settlement details how the $20.5 million can be given to athletes, including 75% to football players, 15% to men’s basketball players, 5% to women’s basketball players and the remaining 10% to all other athletes. This accounts for $13.5 million for football, $2.7 million and $900,000 for women’s basketball players. However, NM State is unlikely to give $20.5 million to its athletes due to its financial situation within athletics. USA TODAY reported NM State’s athletics revenue at $30,350,192 for the 2021-22 fiscal year, while data from the Equity in Athletics Data Analysis shows NM State’s revenue as $35,828,331 for the 2022-23 fiscal year. Burdge informed the Sun-News that the exact totals of what will be given to student-athletes and teams will be worked out in the coming months. She also said the total amount given to all student-athletes and how many scholarships the university can add for the next academic year has not been determined yet. The settlement marks a fundamental shift in how schools will approach NIL-related matters, and ones that NM State’s new NIL leaders will have take on. A-Mountain Sports, NM State’s official NIL collective, recently gained new leaders last November in Paul Smith, Luke Smith and Jordan Banegas. The trio replaced Paul Grindstaff, who joined Vanderbilt’s Anchor Impact NIL collective in October. The House settlement is also a driving factor behind the NM State’s $137 million endowment request for women’s sports. Former NM State athletic director Mario Moccia told the Sun-News back in October about his belief that women’s sports could get left behind due to the settlement, and the endowment request was a proactive move to make sure female Aggie athletes would be taken care of. Rahim Johnson, 43, has been charged with murdering Victoria Lee, 26, who had been reported missing on Jan. 30. Her body was found by police on Feb. 25. During a police interview, Johnson admitted arguing with Lee on Jan. 24 and alleged she cut him with a knife. He said he attempted to stop her but because he was “out of it,” he was unsure if he had something to “do with it or not,” the affidavit of probable cause states. Once Johnson said he “came to,” Lee was dead so he hid her under the bed and took her cell phone and used it along with her banking apps, the court document states. The criminal complaint indicates an electrical cord was used to strangle Lee. On Jan. 30 Lee’s father reported her missing to the Plainsboro Police Department. Her father reported last seeing his daughter at her Plainsboro home on Jan. 24 and that his daughter’s boyfriend, Rahim “Yak-Qui” P. Johnson also lived at the home. Lee’s father said he last saw Johnson at the home on Jan. 25, the affidavit of probable cause states. After Lee was reported missing, several people told police they had received text messages from her requesting money through Zelle and Cash App accounts. Lee’s bank records show transactions made in Trenton during the time Lee was missing including up until Feb. 25 when her body was found by police. Earlier: Trenton man charged with murdering Plainsboro woman who was reported missing in January Besides *******, Johnson, who has a criminal record, has been charged with third-degree unlawful possession of a weapon and fourth-degree possession of a weapon for an unlawful purpose. He is being held at the Middlesex County Adult Correction Center in North Brunswick. Johnson was arrested in Trenton on Feb. 26 on a parole violation. The state Department of Corrections website shows Johnson, who was released from prison on Oct. 23, 2024, has a criminal record dating back to 2002 for receiving stolen property. The website also lists prison sentences for resisting arrest/eluding, endangering the ******** of a child, burglary, receiving stolen property and simple assault. The most recent proposal now includes plans to replace the eight slot windows that span the entire length of the 14-story hospital. In 2021, the Regents approved spending $10 to $15 million to replace the windows on levels four and five at the then 4-year-old facility. The board moved to replace the windows on levels three through 11 as well as the “connector bridge” to the John Pappajohn Pavillion for $45 million during its 2023 February meeting. The project is being funded by University Hospitals Building Usage Funds. The consultants identified additional concerns with the conditions of the current slot windows and recommended a full replacement. “During continued active monitoring, additional concerns regarding the performance of the slot windows have been identified that warrant replacement of all these windows to maintain both safety and building envelope integrity,” according to board documents. In a communication sent to patients and their families from Bradley Haws , CEO of University of Iowa Hospitals & Clinics, assured how the hospital is committed to safety during the ongoing construction. “While you may see us actively monitoring and replacing windows here at University of Iowa Stead Family Children’s Hospital, there is no cause for concern,” Haws said. “A team continues to monitor the windows, so you may occasionally see workers outside. As an added safety measure, fencing has been installed as work happens above.” Window replacement began in 2023 and is expected to last for much of 2026. What to know: University of Iowa sues a pair of contractors tasked with building hospital The University of Iowa claimed a pair of contractors are to blame for installing faulty windows at its $392.7 million children’s hospital. The University of Iowa sued Cupples Construction of Normal, Illinois, and Knutson Construction of Iowa City in 2022, five years after the building was completed. In the lawsuit, the university claimed that both defendants breached their contracts by failing to provide insulated glass units (IGUs) that met performance standards, including resistance to wind, heat, and impact loads. The university said the windows had “systemic defects” as a result of “absent mitigation and stabilization efforts” by the contractors that caused “potentially life-threatening” conditions. The University of Iowa said the issues were not discovered until the building was finished. The school, according to the lawsuit, said they installed a “protective film” and “clips” on the outside of each window to prevent broken glass from falling on patients or staff should the windows break. The university also claimed that many of the windows showed signs of cracking and delamination and that they observed “blemishes” on the “coating surface” on almost 40 percent of the windows. University of Iowa officials said the defective windows could not be repaired and instead needed to be replaced by the contractors. The case went to arbitration in September 2022 and received a court extension for a scheduled trial in 2024. The case never made it to trial and was dismissed last month “without prejudice,” meaning that the University of Iowa can refile at a later date.
