Police consider ‘offer’ in fatal alleged Sydney street race case: court

Lawyers representing a man accused of drag racing moments before a horror ****** that ******* two young brothers have made an offer to prosecutors, a court has been told.

Adam Yurun did not appear before Downing Centre Local Court on Thursday as he faces eight driving-related offences, including aiding dangerous driving occasioning ******.

Police allege the 24-year-old was racing Jimmy Martin Brito, 33, when Mr Brito’s Subaru WRX smashed into a tree at a busy intersection in Sydney’s south in August last year.

Almost a year after the ******, NSW DPP solicitor Briged Diaz-Collian said the Crown was considering an offer made to them two days prior by Mr Yurun’s lawyer, Ahmed Dib.

Ms Diaz-Collian told Judge Michael Allen the DPP would need time to consider the offer and asked for the matter to be adjourned until August 28, with Mr Yurun still on bail.

The other alleged driver, Mr Brito, also did not appear in court on Thursday while he remained in custody on remand and will return to the same court on August 29.

Mr Brito’s lawyer told the court the “solicitor with carriage informed me that after an AVL meeting yesterday professional issues had arisen” but did not elaborate further.

Justice Allen responded that he didn’t “want to be in a position on the next occasion that I’m told further reasons that won’t be disclosed that the solicitor cannot be briefed”.

Police allege Mr Brito was racing Mr Yurun, who was driving an Audi and reaching speeds of up to 136km/h on The Grand Parade in Monterey before he lost control of the car.

Officers previously alleged Mr Brito crossed over two lanes of traffic and onto the wrong side of the road before ploughing into a pole, ******** his nephews Peter Aberu, 9, and Xavier, 10.

He is facing 10 charges, including two counts of manslaughter and dangerous driving occasioning ******, and one charge of organising or promoting a “race between vehicles”.

Raquel Marie Borg, 24, who was in the car with Mr Yurun, also faces charges of concealing a serious indictable offence after she allegedly did not stop to help or call police.

None of the three accused have entered any pleas.
