The teenager appeared in Albany Children’s Court on Friday for sentencing on one charge of unlawful wounding after pleading guilty on June 21. Police prosecutor Warrick Walker told the court how on May 21 at 8.20pm the 13-year-old stabbed a 17-year-old twice in the buttocks with a pocketknife after beating him up with four other teenagers and an 18-year-old male in an Orana carpark. Aboriginal Legal Service lawyer Raymond Muir represented the 13-year-old and said his client was “easily influenced” by peers and that his lack of consequential thinking and parental supervision led to his “unsavoury” actions. Mr Muir argued his client’s youth was a mitigating factor and had been recently dealing with the stress of losing a close family member and role model. He requested a youth community-based order for his client. Sgt Walker requested an intensive youth supervision order for the teenager, saying that if he were an ******, he would be facing jail time. He said the stabbing could have been fatal if the victim had bled out. Magistrate Erin O’Donnell said the teenager appeared to have been peer-pressured into bad situations. “You’ve been caught up with people who are leading you astray,” she said. “To stab any person, in any area, is a really serious matter. “A person can bleed out if stabbed. “If you were an ******, there would be no doubt you would go to jail.” Ms O’Donnell said the teenager was on the “lower end” of the age of offenders the court dealt with and sentenced him to a 10-month youth community-based order with supervision and program requirements.
