Cane Tyree: Alleged car jacker and co-accused Chan Dinh face Perth court after violent CBD robbery

One of two men accused of a terrifying car jacking in the Perth CBD has been emphatically refused bail after “begging” a court for “one more chance”.

Perth Magistrates Court on Monday was told Cane Andrew Tyree, 33, had “grabbed” and then violently dragged a rideshare driver from his car early Sunday morning, while it was stopped at an intersection on Newcastle Street.

“The victim was just literally sitting at an intersection and they’ve come up and stolen the car,” Police prosecutor Gibbson told the court.

When the man was out of the car, co-accused Chan Nat Dinh allegedly punched the man, before “demanding the keys from the victim”.

Prosecutor Gibbson told Magistrate Belinda Coleman Mr Dinh eventually located the keys in the centre console of the car and hopped behind the wheel while Mr Tyree “placed his bag in the rear seat of the vehicle” and sat in the passenger seat.

A short time later, police spotted the allegedly stolen vehicle on Pickering Brook Road, but Mr Dinh, 31, allegedly failed to stop after officers activated their lights and sirens.

As a result the police vehicle gave chase, with Mr Dinh accused of accelerating away and driving at excessive speed.

The pursuit came to a crashing end a short time later when Mr Dinh allegedly slammed into an embankment, and the two men were arrested in nearby bushland after a short alleged foot chase.

Perth Magistrates Court was told Mr Tyree was currently on a community based order which had been imposed on April 22 for one count of aggravated common assault, and that he’d entered into a bail undertaking for that alleged offence on June 6 — two days before the alleged carjacking.

Prosecutor Gibbson said “within 24 hours he has reoffended in the CBD”, claiming that the short turnaround “demonstrates a lack of concern for bail conditions and willingness to reoffend”.

Mr Tyree told Ms Coleman the alleged offending was completely “out of character” for him and that he was currently living on the street and sleeping on a yoga mat, to which Ms Coleman responded: “What do you mean this is totally out of character?

“I’m willing to do anything I can to show the court that that is totally out of character for me,” he said. “I don’t want to be on this side of the fence anymore I don’t want to do this kind of stuff anymore, it’s not good.

“Your Honour I’m begging you for one more chance.”

Despite the plea, Ms Coleman told Mr Tyree: “You’re not getting it (bail).”

“Bail is opposed by the prosecution . . . and I agree. I don’t consider there are any conditions I can impose which will ensure that you wont continue to commit offences taking into account what I have heard.

“Your bail is refused.”

Mr Tyree, who is charged with one count each of aggravated robbery, steal motor vehicle and drug possession was remanded in custody until July 21 for legal advice on video link.

His co-accused, Mr Dinh, is charged with aggravated robbery, driving on a suspended licence, steal motor vehicle, reckless driving to escape pursuit and failing to comply with a direction.

He did not apply for bail and was remanded until the same date, when it is likely he will make his own bid for bail.
