) – A 45-year-old man was arrested early Saturday morning, Oct. 5 for driving while intoxicated after a fatal ********* at a Whataburger in West El Paso left another man *****, according to the El Paso Police Department (EPPD).

EPPD said on Oct. 5 officers from the Driving While Intoxicated Task Force responded to assist after a report had been made about a ********* in the parking lot of the Whataburger located at 650 Sunland Park Drive.

The investigation determined Hector Manuel Lopez Jr., 45, was driving while intoxicated and was placed under arrest with a $5,000 bond, according to EPPD.

Court documents obtained by KTSM say upon officers’ arrival, Lopez Jr. was found to be sitting at the drive-thru in a Ford F150 with damage to the driver’s side window.

Officers observed Lopez Jr. to have glass on his face from the damaged window. He also had glossy eyes, was slurring his speech and smelled like alcohol, according to court documents.

He was also found to have a prior DWI conviction back in February 2015, according to court documents.

Court documents say Lopez Jr. was the only one inside the truck when officers approached him.

Lopez Jr. stayed silent when questioned by law enforcement, according to court documents.

EPPD also said Edgar Gabriel Lucero, 37, from Sunland Park, New Mexico, ***** from injuries sustained in the *********. Police did not release any other details about the *********, but said it continues to be investigated by its ******* Against Persons Unit

EPPD initially reported that the ********* happened around 11:15 p.m. Friday, and said they arrested Lopez at approximately 2:20 a.m. on Saturday.
